C. whereas there were reports of former President Mohamed Nasheed having effectively been denied appropriate legal representation at the court hearing of 23 February 2015 and access to copies of the trial proceedings necessary to lodge an appeal; whereas former President Mohamed Nasheed has therefore not been able to lodge an appeal against the sentence in due time and form;

B. whereas, on 13 March 2015, former President Mohamed Nasheed was sentenced to 13 years under the Maldives’ Anti-Terrorism Act 1990 on the charge that he had ordered, as then president of the country, the unlawful detention of Criminal Court Chief Judge Abdullah Mohamed in 2012; whereas Mr Nasheed has denied this charge;
B. considérant que, le 13 mars 2015, l'ancien président Mohamed Nasheed a été condamné à treize ans de prison en vertu de la loi antiterroriste de 1990 des Maldives parce qu'il aurait ordonné, en tant que président du pays, l'arrestation illégale du juge en chef du tribunal pénal, Abdullah Mohammed, en 2012; que M. Nasheed a rejeté cette accusation;

A. whereas the first democratically elected President of the Republic of Maldives, Mohamed Nasheed, who had been accused of ‘terrorism’, was sentenced on Friday, 13 March 2015 to 13 years in prison; whereas a former defence minister and a member of parliament were convicted in the same case of the detention of a serving chief judge accused of corruption in 2012; whereas two of the three judges in the case also testified against Mohamed Nasheed during the course of the investigation;
A. considérant que le premier président démocratiquement élu de la République des Maldives, Mohamed Nasheed, accusé de "terrorisme", a été condamné vendredi 13 mars 2015 à treize ans de prison; considérant également que l'ancien ministre de la défense et un député ont été condamnés dans la même affaire d'arrestation, au cours de son mandat, d'un juge en chef (Chief judge) de la Cour pénale accusé de corruption en 2012; considérant que deux des trois juges de ce cas étaient également témoins contre Mohamed Nasheed pendant l'investigation;

4. Deplores the serious irregularities in the trial of former President Mohamed Nasheed; calls on all sides to work together for repairing the negative consequences of these irregularities with the aim of ensuring that justice prevail in a free, fair and transparent process; calls on the judicial authorities concerned to facilitate the filing of an appeal by Mr Nasheed; insists that should his conviction be appealed, Mr Nasheed’s rights must be fully respected in line with the Maldives’ international obligations, its own national constitution, and international standards; urges the EU Delegation to Sir Lanka and the Maldives to follow closely the appeal process;
4. déplore les graves irrégularités dans le procès de l'ancien président Mohamed Nasheed; demande à toutes les parties de travailler ensemble à la réparation des conséquences négatives de ces irrégularités en vue d'assurer la primauté de la justice dans un procès libre, équitable et transparent; invite les autorités judiciaires concernées à faciliter l'introduction d'un recours par M. Nasheed; insiste sur le fait que si M. Nasheed fait appel de sa condamnation, ses droits devront être pleinement respectés, conformément aux obligations internationales des Maldives, à sa Constitution et aux normes internationales; demande instamment à la délégation de l'Union au Sri Lanka et aux Maldives de suivre de près la procédure d'appel;
