IN-CONTEXT TRANSLATIONS

The former reinforces guarantees safeguarding the fundamental right to asylum, in particular, by strengthening the right to access asylum procedures (Articles 18 and 19), whereas the latter includes improved and clearer standards to more effectively safeguard the fundamental right to dignity, especially as regards vulnerable asylum seekers and further harmonises the rules on detention, laying down clear and restrictive grounds, conditions for detention, and guarantees for detainees (Articles 1, 4, 6, 7, 18, 21, 24, and 47).

Highlights that also the European Parliament should strengthen its autonomous impact assessment on fundamental rights in relation to legislative proposals and amendments under examination in the legislative process to make it more systematic, notably by enlarging the possibilities currently foreseen by Rule 36 of the Parliament's Rules of Procedure on the respect for the Charter and to ask to the Legal Service opinions on legal issues in relation to fundamental rights issues in the EU;

We call for the European Union to be more explicitly involved and for this Community, which seeks to promote democracy and freedoms, to become not just a forum for debate but a genuine international institution based on a binding agreement laying down, inter alia, clear criteria for accession. These criteria must include the respect for human rights by the ‘good’ States involved in combating terrorism too and the practical recognition of fundamental freedoms, starting with the equality of citizens before the law and the freedom of the press, which are currently being violated extensively even in the different Member States of the Union – a prime example being Berlusconi’s Italy – and they must, in any case, be in line with the Charter of Fundamental Rights which the European Union approved at the Nice European Council.

The EU’s Charter of fundamental rights that was produced in 2000 does not go as far as some provisions enshrined in Member State constitutions, the European Social Charter and the Council of Europe's European Convention for the Protection of Human Rights and Fundamental Freedoms, which applies to an area greater than the EU alone. This is why it is wrong to equate a proper arrangement of constitutional rights with a document that is no more than the outcome of a discussion of a convention that mapped out the common denominator of various wishes without taking a vote.
La charte des droits fondamentaux de l'UE, élaborée en l'an 2000, va moins loin que certaines dispositions reprises dans les constitutions des États membres, ou encore dans la charte sociale européenne et la Convention européenne de sauvegarde des droits de l'homme et des libertés fondamentales adoptée par le Conseil de l'Europe et qui est applicable sur un territoire plus grand que celui de la seule UE. Il est dès lors anormal d'assimiler à une bonne réglementation de la question des droits fondamentaux un document qui n'est rien de plus que le résultat des discussions d'une Convention qui, sans procéder au moindre vote, a dégagé le plus grand commun dénominateur à partir d'aspirations divergentes.

Those who are more backward and more reactionary have, once again, triumphed over those who are fighting to see fundamental rights applied to all people and for an effective, legally binding response to new issues such as the risks of science, the rights of the new citizens, the right to a healthy environment etc. Consequently, we are once again left disappointed and dissatisfied.

To this end, it is necessary to strengthen the protection of fundamental rights in the light of changes in society, social progress and scientific and technological developments by making those rights more visible in a Charter.
