I also want to acknowledge women who were with the Indian Rights for Indian Women group: Nellie Carlson, Jenny Margetts for the Native Women's Association of Canada that came out of Indian Rights for Indian Women; Jane Gottfriedson and Gail Stacey-Moore all have left without seeing what they have been fighting for.

Although the rule is gender neutral for children born after 1985, it created a relative disadvantage for the descendants of First Nations women who had married out and regained status under subsection 6(1) because their children, born before 1985 and registered under subsection 6(2), were unable to transmit status onward if they married non-Indians (50% descent).31 In contrast, the children of Indian men who had married non-Indian women before 1985 were registered under subsection 6(1) and, despite having the same degree of Indian ancestry as subsection 6(2) registrants, were able to transmit status to their offspring when they married out.

That, in the opinion of the House, the Indian Act is the embodiment of failed colonial and paternalistic policies which have denied First Nations their rights, fair share in resources; fostered mistrust and created systemic barriers to the self-determination and success of First Nations, and that elimination of these barriers requires the government to initiate a formal process of direct engagement with First Nations within three months of passage of this motion, on a nation-to-nation basis, which focuses on replacing the Indian Act with new agreements based on: (a) the constitutional, treaty, and inherent rights of all First Nations; (b) the historical and fiduciary responsibilities of the Crown to First Nations; (c) the standards established in the United Nations Declaration on the Rights of Indigenous Peoples, including the principle of free, prior, and informed consent; (d) respect, recognition, reconciliation and support for First Nations; (e) partnership and mutual accountability between the Crown and First Nations; and (f) stability and safety of First Nations; and that this process be completed within two years before reporting with a series of concrete deliverables for the government to act upon.

15. Welcomes, with regard to respect for human rights, India’s cooperation with the UN Human Rights Council, but regrets that India has not yet ratified the international Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment; urges the Indian Government immediately to abolish the death penalty by imposing a moratorium on executions; encourages the Indian Government to sign and ratify the Optional Protocol to the Convention on the Elimination of All Forms of Discrimination against Women; urges India to sign up to the International Criminal Court;

As a founding member of Indian Rights for Indian Women and the Indian Homemakers Association, Ms. Charlie was at the forefront in challenging the Indian Act that deprived First Nations women of their status when they married non-Indians.
