C. whereas the Treaties provide that Member States are to adopt all measures of national law necessary to implement legally binding Union acts; whereas, however, where uniform conditions for implementing legally binding Union acts are needed, those acts are to confer implementing powers on the Commission (and in certain exceptional cases on the Council), as laid down in Article 291 TFEU; whereas where the basic act requires that the adoption of implementing acts by the Commission must be subject to control by the Member States, the basic act should confer those implementing powers on the Commission in accordance with Regulation (EU) No 182/2011; whereas a key commitment made by the Commission in a statement annexed to that Regulation was the urgent alignment of the acquis to the new system of delegated and implementing acts to be completed during the current legislative term, including basic acts referring to the regulatory procedure with scrutiny (RPS);

The Commission should adopt a delegated act within 3 months of receipt of the opinion and advice from ESMA, taking into account the criteria listed in, and the objectives of, this Directive, inter alia, relating to the internal market, investor protection and the effective monitoring of systemic risk, specifying the date when the national regimes referred to in this Directive should be brought to an end in all Member States.

Delegated acts referred to in Articles 1(4)(e)(i) , 1(4)(f) and 1a(3b) shall amend Annex II by inserting in the reference to the third country concerned the information on the dates of the beginning and of the end of suspension of the exemption from the visa requirement for the nationals of that third country.

If there is objection to the delegated act referred to in the first subparagraph in accordance with Article 58, the Commission shall re-adopt the delegated act pursuant to which the national regimes set out in Articles 36 and 42 are to be terminated and the passport regime provided for in Article 35 and Articles 37 to 41 shall become the sole and mandatory regime applicable in all Member States, in accordance with Article 56 and subject to the conditions of Articles 57 and 58, at a later stage which seems appropriate to it, taking into account the criteria listed in paragraph 2 and the objectives of this Directive, such as those relating to the internal market, investor protection and the effective monitoring of systemic risk.

Most smaller national delegations consider this to be a poor proposal, partly because unnecessary interference obscures the division of tasks between the Member States and the Union, and partly because it may be used inappropriately in order to cut down on civil rights, such as the freedom of demonstration, by referring to the protection of infrastructure, in which case it does not affect international terrorism, but rather domestic democracy.

3. The national intermediary bodies shall take all the steps necessary for executing the implementing tasks delegated to them as detailed in Part II(2) of the Annex as regards the selection and management of the local, regional and national actions referred to in Part II(4) of the Annex.
