Where the Member State concerned does not provide the information requested within the period prescribed by the Commission or within a commonly agreed period, or where the Member State provides incomplete information, the Commission shall send a reminder setting a new deadline for the submission of the information.

On 4 June 2008, not having received a reply to the first reminder letter within the prescribed time limit, the Commission services sent a new reminder letter drawing the attention of the Belgian authorities to the fact that if the four-week time limit assigned for the sending of a reply was not complied with, the Commission could send an information injunction according to Article 10(2) and (3) of Council Regulation (EC) No 659/1999 of 22 March 1999 laying down detailed rules for the application of Article 93 of the EC Treaty (4).

The Commission reminds Member States of their duty to notify to the Commission their plans to grant new aid, in accordance with Article 88(3) of the Treaty and Article 2 of Council Regulation (EC) No 659/1999 of 22 March 1999 laying down detailed rules for the application of Article 93 of the EC Treaty (3).

Notes the increase of EUR 1.242 million in the sheepmeat and goatmeat sector deriving from the agreement reached within the Council of EU Ministers for Agriculture to switch from a price support system to a system of income as stated by the Commission; reminds that according to the legislative proposal (COM(2001) 247), the new regulation should entail only a minor increase in funding; considers that the market situation in the sheep and goat sector is improving after the latest FMD crisis; therefore asks the Commission to provide further information on the reasons for such a discrepancy in funding and, if necessary, to adjust the market organisation accordingly; expresses its concern about the amounts proposed by the Commission for the budget lines B1-401, B1-404 (Less-favoured regions), B1-4050 (Agri-environment - new system) and B1-4072 (Afforestation);
16. prend acte de l'accroissement de 1,242 milliard d'euros dans le secteur de la viande ovine et caprine par suite de l'accord conclu au sein du Conseil des ministres de l'agriculture de l'UE en faveur du passage d'un système de soutien des prix à un système de soutien des revenus ainsi que l'annonce la Commission; rappelle que, conformément à la proposition législative COM(2001) 247, le nouveau règlement ne devrait déboucher que sur une augmentation modeste des financements; estime que la situation du marché dans le secteur ovin et caprin s'améliore depuis la dernière crise de la fièvre aphteuse; invite donc la Commission à fournir des informations supplémentaires sur la motivation d'un tel écart dans le financement et, si nécessaire, à adapter l'organisation du marché en conséquence; exprime son inquiétude quant aux montants proposés par la Commission pour les lignes B1‑401, B1‑404 (régions défavorisées), B1–4050 (nouveau système agro-environnemental) et B1‑4072 (boisement);

As a reminder, in point 240 of the decision initiating the procedure, the Commission concluded, as regards the interpretation of points 102 to 104 of the 2004 guidelines for this case, that ‘if SNCB decides not to award the new asset to IFB, and if the evidence is forthcoming that SNCB was engaged in converting its receivables into capital before the publication of the 2004 guidelines, the Commission would have to examine in its final decision the aid granted to IFB by the SNCB on the basis of the 1999 guidelines’.

35. Stresses again that the Commission shall include in its assessment of staff needs what the staff requirements are to maintain core activities and run existing programmes, as well as estimates for additional staff for new activities; reminds the Commission that the Letter of Amendment needs to be presented before mid-September in order to be taken into account in Parliament's first reading; notes that in this connection it needs to be examined how far tasks which are now carried out by the Commission are actually tasks to be carried out by the Member States;
35. souligne à nouveau que la Commission doit indiquer, dans son évaluation des besoins en personnel, les besoins en personnel afférents au maintien des activités essentielles et à la gestion des programmes existants, ainsi que les prévisions de personnel supplémentaire à affecter à des activités nouvelles; rappelle à la Commission que la lettre rectificative doit être présentée avant la mi-septembre, de manière à être prise en compte lors de la première lecture du Parlement; note que, à cet égard, il faut examiner dans quelle mesure des tâches actuellement accomplies par la Commission devraient l'être, en fait, par les États membres;
