E. whereas, although civil society has a crucial role to play in the transition towards democracy, international and domestic NGOs are facing increasing pressure, hostile attacks, harassment and intimidation in Egypt; whereas, on 4 June 2013, a Cairo criminal court convicted 43 foreign and Egyptian NGO workers to up to five years in prison for civil society activities and ordered the closure and the confiscation of assets of local branches of five international NGOs which had been operating in Egypt for a long time, namely the Konrad Adenauer Foundation, the National Democratic Institute, the International Republican Institute, Freedom House and the International Center for Journalists; whereas these court sentences are part of a campaign of intimidation by government authorities against NGOs in Egypt;

The electoral committee itself is headed by the same people who have spearheaded the attack on the U.S. NGOs in Egypt, and were blamed, for the wrong reasons, for interfering in judicial matters by allowing foreign workers to leave Egypt.

A. whereas the situation of NGOs in Egypt is alarming; whereas the establishment of a committee to review civil institutions and NGOs, with the aim of tightening legal control over foreign funding of civil society organisations and political foundations, was announced in October 2011 and a request was subsequently made to the Central Bank to monitor all bank transfers to and from NGOs; whereas the offices of 10 foreign-funded organisations were searched and those organisations were investigated and then banned by the Supreme Council of the Armed Forces (SCAF) on 29 December 2011; whereas on 5 February 2012 Egypt's military-led government announced that it was putting 19 American citizens and 24 others on trial as part of a criminal investigation into the foreign financing of non-profit-making organisations active in Egypt; whereas Egyptian judges are investigating alleged illegal foreign financing of pro-democracy NGOs and political foundations, and whereas 44 defendants, including 19 Americans, 14 Egyptians, five Serbs, two Germans, two Lebanese, one Jordanian and one Palestinian, have had their cases referred to the Cairo Criminal Court and ordered not to leave the country;

B. whereas the NGOs also stand accused of establishing and running offices in Egypt without government authorisation, even though applications for registration made by the organisations in accordance with the relevant rules have not been acted on by the Egyptian authorities for over five years; whereas these charges are the culmination of an escalating legal crackdown on national and international NGOs in Egypt, an approach which is at odds with international human rights law and is undermining efforts to promote democratic values and safeguard human rights;
B. considérant que des ONG font également face à des accusations pour avoir ouvert et géré des bureaux en Égypte sans autorisation des pouvoirs publics, alors que les demandes d'enregistrement déposées par ces organisations conformément à la législation correspondante il y a plus de cinq ans n'ont pas été prises en compte par les autorités égyptiennes; considérant que ces accusations constituent le point culminant de l'escalade qu'a connu la répression juridique menée à l'encontre des ONG nationales et internationales en Égypte, démarche qui va à l'encontre du droit international des droits de l'homme et compromet les efforts déployés pour promouvoir les valeurs démocratiques et protéger les droits de l'homme;

While fully respecting the independence of the judicial system in Egypt, the EU intends to monitor closely the ongoing legal proceedings against NGO staff and underlines expectations regarding due process.

The "EESC-Euromed NGOs Symposium" brought together a wide range of organisations from Tunisia, Egypt, Morocco, the Palestinian territories, Lebanon and Algeria.
