At that meeting, an examination of the proposal for a Regulation of the European Parliament and of the Council codifying Council Regulation (EC) No 1515/2001 of 23 July 2001 on the measures that may be taken by the Community following a report adopted by the WTO Dispute Settlement Body concerning anti-dumping and anti-subsidy matters resulted in the Consultative Working Party’s concluding, without dissent, that the proposal is a straightforward codification of existing texts, without any change in their substance.

Article 2 of Council Regulation (EC) No 1515/2001 of 23 July 2001 on the measures that may be taken by the Community following a report adopted by the WTO Dispute Settlement Body concerning anti-dumping and anti-subsidy matters (13) (‘the enabling Regulation’) provides that the Council of the European Union may, inter alia, amend Union measures taken pursuant to the basic Regulation in order to take into account the legal interpretations made in a report adopted by the WTO Dispute Settlement Body with regard to a non-disputed measure, if it considers this appropriate.

In the notice of initiation, the Commission also announced the initiation of a review pursuant to Article 2(3) of Regulation (EC) No 1515/2001 (‘review pursuant to Regulation (EC) No 1515/2001’) in order to allow for any necessary amendment of Regulation (EC) No 452/2007 in the light of the WTO Appellate Body report entitled ‘Mexico — Definitive Anti-dumping Measures on Beef and Rice’ (AB-2005-6) (5) (the ‘WTO Appellate Body report’).
