Commission Decision 2010/670/EU of 3 November 2010 laying down criteria and measures for the financing of commercial demonstration projects that aim at the environmentally safe capture and geological storage of CO as well as demonstration projects of innovative renewable energy technologies under the scheme for greenhouse gas emission allowance trading within the Community established by Directive 2003/87/EC of the European Parliament and of the Council (OJ L 290, 6.11.2010, p. 39).
Décision 2010/670/UE de la Commission du 3 novembre 2010 établissant les critères et les mesures pour le financement de projets commerciaux de démonstration axés sur le captage et le stockage géologique du CO sans danger pour l'environnement, ainsi que de projets de démonstration de technologies innovantes liées aux énergies renouvelables, dans le cadre du système d'échange de quotas d'émission de gaz à effet de serre dans la Communauté établi par la directive 2003/87/CE du Parlement européen et du Conseil (JO L 290 du 6.11.2010, p. 39).

The European Parliament has already spoken on this issue in the 2010 INI report of Mr Szájer on the power of legislative delegation, whereby it insisted “that the co-legislators have the power to decide that the matters previously adopted under the regulatory procedure with scrutiny (RPS) can be adopted either under Article 290 TFEU or under the ordinary legislative procedure”, not through implementing acts.
Le Parlement européen s'est déjà prononcé sur cette question dans le rapport INI de 2010 de M. (26) The Commission should adopt draft regulatory technical standards developed by ESMA, EBA and EIOPA according to Article 8 regarding the methodology underpinning the presentation of risk and reward and the calculation of costs and environmental social or governance criteria by the means of delegated acts pursuant to Article 290 of the Treaty on the Functioning of the European Union and in accordance with the respective Articles 10 to 14 of the Regulations (EU) No 1093/2010, 1094/2010 and 1095/2010 of the European Parliament and of the Council .
(26) La Commission devrait adopter des projets de normes techniques de réglementation conçus par l'AEMF (Autorité européenne des marchés financiers), l'ABE (Autorité bancaire européenne) et l'AEAPP (Autorité européenne des assurances et des pensions professionnelles) au titre de l'article 8 en ce qui concerne la méthode de présentation des risques et des rémunérations et le calcul des coûts et des critères environnementaux, sociaux ou de gouvernance , au moyen d'actes délégués adoptés en vertu de l'article 290 du traité sur le fonctionnement de l'Union européenne et conformément aux articles 10 à 14 des règlements (UE) nº 1093/2010, 1094/2010 et 1095/2010 du Parlement européen et du Conseil .

(26) The Commission should adopt draft regulatory technical standards developed by ESMA, EBA and EIOPA according to Article 8 regarding the methodology underpinning the presentation of risk and reward and the calculation of costs and environmental social or governance criteria by the means of delegated acts pursuant to Article 290 of the Treaty on the Functioning of the European Union and in accordance with the respective Articles 10 to 14 of the Regulations (EU) No 1093/2010, 1094/2010 and 1095/2010 of the European Parliament and of the Council.
(26) La Commission devrait adopter des projets de normes techniques de réglementation conçus par l'AEMF (Autorité européenne des marchés financiers), l'ABE (Autorité bancaire européenne) et l'AEAPP (Autorité européenne des assurances et des pensions professionnelles) au titre de l'article 8 en ce qui concerne la méthode de présentation des risques et des rémunérations et le calcul des coûts et des critères environnementaux, sociaux ou de gouvernance, au moyen d'actes délégués adoptés en vertu de l'article 290 du traité sur le fonctionnement de l'Union européenne et conformément aux articles 10 à 14 des règlements (UE) nº 1093/2010, 1094/2010 et 1095/2010 du Parlement européen et du Conseil.

(50) The Commission should be empowered to adopt delegated acts in accordance with Article 290 of the Treaty as well as regulatory technical standards in accordance with Articles 10 to 14 of Regulation (EU) No 1095/2010 in respect of the details to be included in the notification to ESMA and in the register and the criteria for the decision of ESMA on the eligibility for the clearing obligation, on the information and clearing threshold, on the maximum time lag regarding the contract, on liquidity, on the minimum content of governance rules, on details of record keeping, on minimum content of business continuity plan and the services guaranteed, on percentages and time horizon for margin requirements, on extreme market conditions, on highly liquid collateral and haircuts, on highly liquid financial instruments and concentration limits, on details for performance of tests, on details concerning the application of a trade repository for registration with ESMA, on fines and on details concerning the information that a trade repository should make available, as referred to in this Regulation.
(50) La Commission devrait être en mesure d’adopter, conformément à l’article 290 du traité, des actes délégués et, conformément aux articles 10 à 14 du règlement (UE) n° 1095/2010, des normes techniques réglementaires relatifs aux informations à inclure dans la notification à l’AEMF et dans le registre, et relatifs aux critères de décision de l’AEMF concernant: l’éligibilité à l’obligation de compensation centrale; les seuils d’information et de compensation; le délai maximal de confirmation du contrat; la liquidité; le contenu minimal des règles de gouvernance; les modalités de conservation des informations; le contenu minimal du plan de continuité des activités et les services garantis; les pourcentages et échéances applicables aux marges; les conditions de marché extrêmes; les garanties très liquides et les décotes; les modalités de conduite des tests; les informations à inclure dans une demande d’enregistrement présentée par un référentiel central à l’AEMF; les amendes et les informations qu’un référentiel central doit rendre disponibles; conformément au présent règlement.
