TRADUCTIONS EN CONTEXTE

In February 2017, the Commission opened the infringement proceedings by sending a letter of formal notice. The Commission raised concerns that these rules go against the principle of the free movement of goods (Article 34 of Treaty on the Functioning of the EU, TFEU) and undermine the free formation of selling prices of agricultural products on the basis of fair competition (EU Regulation No 1308/2013 establishing a common organisation of the markets in agricultural products).

9. Stresses that IPR infringing products not only cause a direct loss of revenue to legitimate businesses and the European economy but also lead to direct and indirect job losses, to reputational damage and to increased enforcement costs, whilst often having links with organised crime, in addition to posing a potential threat and being a potential source of damage to consumer health and safety; stresses, in this context, that product quality and safety is not automatically linked to product authenticity, and that IPR status and the possible infringement thereof is governed by a different set of rules than consumer product safety and quality;

‘indirect purchaser’ means a natural or legal person who acquired, not directly from an infringer, but from a direct purchaser or a subsequent purchaser, products or services that were the object of an infringement of competition law, or products or services containing them or derived therefrom.

The Member States shall lay down the rules on penalties applicable to infringements of the provisions of this Regulation that impose obligations on economic operators and to infringements of provisions of any Union harmonisation legislation on products covered by this Regulation that impose obligations on economic operators where that legislation does not provide for penalties, and shall take all measures necessary to ensure that they are implemented.

fines proportionate to the environmental damage, the value of the timber or timber products concerned and the tax losses and economic detriment resulting from the infringement, calculating the level of such fines in such way as to make sure that they effectively deprive those responsible of the economic benefits derived from their serious infringements, without prejudice to the legitimate right to exercise a profession, and gradually increasing the level of such fines for repeated serious infringements.

Where a severe infringement or an infringement with prolonged effect is found, the control authority or control body shall prohibit the operator concerned from marketing products which refer to the organic production method in the labelling and advertising for a period to be agreed with the competent authority of the Member State.
