Although our attempts have often been portrayed by people as an attempt to go to one side or the other, these impressions can only have been formed by people who cannot have seen our preliminary conclusions and proposals, because there is nothing in such a package that weakens our ability to tackle unfair trade, and nothing which fundamentally alters the basis of the operation of our trade defence instruments.

(14) The Union observes the principles recognised by Article 6(2) of the Treaty on European Union and reflected in the Charter of Fundamental Rights of the European Union, notably Chapters II and VI thereof. Nothing in this Framework Decision may be interpreted as being intended to reduce or restrict fundamental rights or freedoms such as freedom of expression, assembly, or of association, freedom of the press and freedom of expression of other media, or the right to respect for private and family life, including the right to respect of the confidentiality of correspondence, which also covers the content of e-mail and other kinds of electronic correspondence.
(14) L’Union observe les principes reconnus par l’article 6, paragraphe 2, du traité sur l’Union européenne et réaffirmés par la charte des droits fondamentaux de l’Union européenne, notamment ses chapitres II et VI. 4. The Czech Republic further stresses that nothing in the Charter may be interpreted as restricting or adversely affecting human rights and fundamental freedoms as recognised, in their respective field of application, by Union law and by international agreements to which the Union or all the Member States are party, including the European Convention for the Protection of Human Rights and Fundamental Freedoms, and by the Member States' Constitutions.
4. La République tchèque souligne en outre qu'aucune disposition de la Charte ne peut être interprétée comme limitant ou portant atteinte aux droits de l'homme et libertés fondamentales reconnus, dans leur champ d'application respectif, par le droit de l'Union et les conventions internationales auxquelles sont parties l'Union, ou tous les États membres, et notamment la Convention européenne de sauvegarde des droits de l'homme et des libertés fondamentales, ainsi que par les constitutions des États membres.

In this field there has been nothing but shameful failures but nevertheless we are still faced with a brick wall which excludes women. This is a very well informed, in-depth, and rigorous report, which is capable of stating fundamental principles with the clarity demonstrated in Paragraph 17. It is audacious but, at the same time, contains considerable practical sense and very necessary proposals.
Dans ce domaine, il n'y a que des échecs honteux et néanmoins, nous nous trouvons encore face à un mur d'exclusion vis-à-vis des femmes. Un rapport très documenté, profond, rigoureux, capable d'énoncer des principes essentiels avec la clarté qui est présente dans l'article 17, audacieux mais à la fois avec un grand sens pratique et des propositions très nécessaires.

– (DE Mr President, the rapporteurs Duff and Voggenhuber, as well as the Committee on Constitutional Affairs, have done some sterling work. The report itself is sound because it conveys the key messages without going so far as to anticipate the work of the fundamental rights convention. I therefore nurture the hope that tomorrow in plenary sitting, this report will be adopted in the form we in the Committee on Citizens’ Freedoms and Rights drafted it in. However there is one point which I would like to be amended. I have tabled an amendment to this effect on behalf of my group. It concerns the question, raised repeatedly today, as to whether the European Union should sign up to the European Convention on Human Rights. This was an important goal in the past. It was an important and appropriate goal in the past precisely because there was no intention, at that stage, to create our own, autonomous catalogue of fundamental rights at European Union level; viewed in this light, it was far better to have that, as a second-best solution, than nothing at all.
- (DE) Monsieur le Président, les rapporteurs Duff et Voggenhuber et la commission des affaires constitutionnelles ont fait du bon travail. Le rapport est bon en tant que tel car il transmet les messages cruciaux sans pour autant anticiper sur le travail de la Convention. Je caresse donc l'espoir que demain, l'Assemblée plénière votera ce rapport tel que nous l'avons élaboré en commission des droits fondamentaux. Il est toutefois un point à propos duquel je souhaiterais une modification. J'ai d'ailleurs introduit, au nom de mon groupe, une proposition d'amendement à ce propos. Elle concerne le thème, plusieurs fois abordé aujourd'hui, de l'adhésion de l'Union européenne à la Convention européenne des droits de l'homme. Cette adhésion à la Convention était un objectif important dans le passé. C'était un objectif important et justifié dans le passé, aussi longtemps qu'il n'y avait pas de perspective de création d'un catalogue des droits fondamentaux propre à l'Union européenne. De ce point de vue, cette solution de second choix était bien meilleure que rien du tout.
