2. This Directive aims to ensure a high level of protection for all road users in the Union by facilitating the cross-border exchange of information on road safety related traffic offences, and thereby facilitating the enforcement of sanctions, where those offences are committed with a vehicle registered in a Member State other than the Member State in which the offence took place.

(28) Since the objective of this Directive, namely to ensure a high level of protection for all road users in the Union by facilitating the cross-border exchange of information on road safety related traffic offences, where they are committed with a vehicle registered in a Member State other than the Member State where the offence took place, cannot be sufficiently achieved by the Member States, but can rather, by reason of the scale and effects of the action, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity, as set out in Article 5 of the Treaty on European Union.

For the purpose of prosecution of the offences laid down in point (a) of Article 3(1), Article 3(2) and (3), where they relate to point (a) of Article 3(1), as well as incitement, aiding and abetting, and attempt to commit those offences, jurisdiction should not be subordinated to the condition that the acts constitute an offence at the place where they were committed.

When sending, with confirmation of receipt and on a strictly confidential basis, the information letter to the owner, the holder of the vehicle or the otherwise identified person suspected of committing the road safety related traffic offence, the Member State of the offence shall, in accordance with its law and with this Directive, include any relevant information, notably the nature of the road safety related offence referred to in Article 2, the place, date and time of the offence, texts of the national law infringed and the corresponding penalty as well as, where appropriate, data concerning the device used for detecting the offence.

3. Any decision under paragraph 1(f)(i) in relation to offences committed partly within the territory of the executing State, or in a place equivalent to its territory, shall be taken by the competent authorities referred to in paragraph 2 in exceptional circumstances and on a case-by-case basis, having regard to the specific circumstances of the case, and in particular to whether a major or essential part of the conduct in question has taken place in the issuing State, whether the EEW relates to an act which is not a criminal offence under the law of the executing State and whether it would be necessary to carry out a search and seizure for the execution of the EEW.
3. Toute décision prise en application du paragraphe 1, point f) i), portant sur des infractions commises en partie sur le territoire de l’État d’exécution ou en un lieu assimilé à son territoire, est prise par les autorités compétentes visées au paragraphe 2 à titre exceptionnel et cas par cas, en prenant en considération les circonstances particulières à chaque espèce et en tenant notamment compte de la question de savoir si les faits considérés se sont déroulés en majeure partie ou pour l’essentiel dans l’État d’émission, si le mandat européen d’obtention de preuves concerne un acte qui n’est pas une infraction pénale au regard du droit de l’État d’exécution et s’il est nécessaire d’effectuer une perquisition et une saisie aux fins de l’exécution du mandat.
