A document concerning an official’s administrative status and which is capable of having a decisive influence on a decision must, as a general rule, have been communicated to the official concerned before it is placed on his personal file.

The appointing authority is not under any obligation to inform the official concerned, prior to its adoption, of the elements on which a decision to reassign him is based in order to enable him effectively to make known his views on the subject, where that decision is not likely to entail appreciable consequences for his career development, where it conforms with the equivalence of posts, where it accedes to the official’s wish to cease performing duties in his area of specialisation or in the immediate environment of the directorate-general in which he has worked, and where it does not involve any change in the official’s place of employment.

In that regard, the fact that an official requested to be appointed to a post of head of unit and that the appointing authority did not accede to that request, but reassigned the official from a post of advisor to another advisor post, is not in itself enough to classify the contested decision as a retaliatory measure against the official concerned.

4. The institution shall be represented before the Joint Advisory Committee by an official designated for that purpose by the Appointing Authority. That official shall have the same rights as the official concerned.

In order to assess the admissibility of an action brought by an official, the Tribunal cannot apply or even be guided by the conditions set out in the fourth paragraph of Article 230 EC (now, after amendment, the fourth paragraph of Article 263 TFEU) and, in particular, the requirement that the contested measure be of individual concern to the official concerned, since those conditions define, essentially, the exercise of the right of natural and legal persons to bring an action against acts of general application, taking account of various circumstances of such a kind as to distinguish the applicant individually.

Until 30 June 2014, with regard to those officials who have been transferred to the EEAS pursuant to Council Decision 2010/427/EU, by way of derogation from Articles 4 and 29 of these Staff Regulations and under the conditions set out in Article 7(1), the Appointing Authorities of the institutions concerned may in exceptional cases, acting by common agreement and solely in the interest of the service, after having heard the official concerned, transfer such an EEAS official from the EEAS to a vacant post of the same grade in the General Secretariat of the Council or in the Commission without notifying the staff of the vacant post.
