The right to a review of a decision not to prosecute does not concern special procedures, such as proceedings against members of parliament or government, in relation to the exercise of their official position.

The possibility of assaults and attacks to public figures, either in an official capacity or in a non-official position, cannot be excluded.

For the purposes of this Decision, “public figure” shall mean any person, either in an official capacity or in a non-official position to whom a protection service is assigned in accordance with the national legislation of a Member State or pursuant to the regulations of an international or supranational organisation or institution’.

For the purposes of this Decision, “public figure” shall mean any person, either in an official capacity or in a non-official position who is deemed to be under threat because of his or her contribution to or impact on the public debate, and who, in the view of the Member State concerned, merits protection, and to whom a protection service is assigned in accordance with the national legislation of a Member State or pursuant to the regulations of an international or supranational organisation or institution’.
Aux fins de la présente décision, on entend par “personnalité”, toute personne qui, dans l'exercice de fonctions officielles ou non, est considérée comme menacée en raison de sa contribution au débat public ou de l'influence qu'elle a sur celui-ci, et qui, de l'avis de l'État membre concerné, mérite de recevoir une protection, et qui bénéficie d'un service de protection conformément à la législation nationale d'un État membre ou en vertu des règles d'une organisation ou institution internationale ou supranationale».
