For the purposes of this Directive, ‘passive corruption’ means the action of a public official who, directly or through an intermediary, requests or receives advantages of any kind, for himself or for a third party, or accepts a promise of such an advantage, to act or to refrain from acting in accordance with his duty or in the exercise of his functions in a way which damages or is likely to damage the Union's financial interests.

For the purposes of this Directive, ‘misappropriation’ means the action of a public official who is directly or indirectly entrusted with the management of funds or assets to commit or disburse funds or appropriate or use assets contrary to the purpose for which they were intended in any way which damages the Union's financial interests.

(a) For the purposes of this Directive, passive corruption shall consist of the action of a public official, who, directly or through an intermediary, requests or accepts in advance advantages of any kind whatsoever or a promise of such an advantage, for himself or for a third party, for acting, delaying action or refraining from acting in accordance with his duty or in the exercise of his functions, whether or not in breach of his official obligations, in a way which damages or is likely to damage the Union's financial interests.

(1) An act of a public official who, directly or indirectly, requests or receives money or other benefits that are not due to him, or does not reject them, in order to perform, fail to perform or delay the completion of an act relating to his duties, or in order to act against those duties, shall be punished by 3-12 years of imprisonment and the loss of certain rights (2) The act referred to in paragraph 1, if committed by a public official having a supervisory role, shall be punished by 3-15 years of imprisonment and the loss of certain rights.

Finally, certain officials and other servants who directly support the president, the judges or the registrar such as legal secretaries or officials of the registry shall be responsible to the registrar of the Community Patent Court under the authority of the president of the Community Patent Court.
Enfin, certains fonctionnaires ou autres agents travaillant directement pour le président, les juges ou le greffier, tels que les référendaires ou les fonctionnaires du greffe, relèveront du greffier du Tribunal du brevet communautaire sous l'autorité de son président.

‘competent official’ means any official who can directly exchange information on the basis of this Regulation for which he has been authorised pursuant to Article 4(3).
