(1) Wine imports under concessions provided for in agreements with certain third countries are subject to the presentation of attestations, issued by official bodies or bodies officially recognised by both contracting parties and appearing on lists drawn up jointly, to the effect that the wine in question meets the conditions for access to the concessions.
(1) Les importations de vin dans le cadre des concessions prévues par des accords avec certains pays tiers sont subordonnées à la présentation d'une attestation délivrée par un organisme officiel ou officiellement reconnu par les deux parties contractantes et figurant sur les listes établies conjointement, attestant que le vin en question est conforme aux conditions d'accès des concessions.

1. The Member States shall send the Commission the lists of official or officially recognised bodies that they propose should issue attestations proving that the wine in question meets the conditions for access to the concessions provided for in the agreements with third countries.
1. Les États membres communiquent à la Commission la liste des organismes officiels ou officiellement reconnus qu'ils proposent pour délivrer les attestations prouvant que le vin en question est conforme aux conditions d'accès des concessions prévues par des accords avec des pays tiers.

(2) The Member States should send the Commission the lists of official or officially recognised bodies that they propose should issue such attestations, so that the Commission can draw up and exchange those lists with the third countries concerned.
(2) Il est souhaitable que les États membres communiquent à la Commission la liste des organismes officiels ou officiellement reconnus qu'ils proposent pour délivrer ces attestations pour que la Commission puisse dresser et échanger la liste conjointement avec le pays tiers concerné.

(b) actions having a clear EU added value co-financed by other public or private bodies, as referred to in article 8 (1), including officially recognised international organisations active in the area of health and for the latter, where appropriate without previous call for proposal, duly justified in the annual work programmes, in accordance with the Financial Regulation and its implementing rules;

(18a) In the context of enhanced efforts to prevent the abuse of contractual freedom to creditors’ detriment, Member States, officially recognised bodies and bodies with a legitimate interest should encourage, with the Commission’s support, the drawing-up and publicisation of codes of conduct and the adoption of conflict resolution systems based on mediation and arbitration, which should be voluntary, should offer suitable complaint procedures and should be negotiated at national or Union level and designed to ensure full observance of the rights set out in this Directive.
(18 bis) Afin de mieux prévenir l'abus de la liberté contractuelle au détriment des créanciers, les États membres et les entités représentatives officiellement reconnues ou ayant un intérêt légitime veillent, avec l'appui de la Commission, à encourager l'élaboration et la diffusion de codes de conduite, ainsi que l'adoption de systèmes de résolution des conflits au travers de la médiation et de l'arbitrage, volontaires et dotés de dispositifs de recours appropriés, négociés au niveau national ou de l'Union, et destinés à assurer l'application effective des droits découlant de la présente directive.

3. The means referred to in paragraph 2 shall include provisions whereby organisations officially recognised as, or having a legitimate interest in, representing enterprises may take action according to the national law concerned before the courts or before competent administrative bodies on the grounds that terms or commercial practices, including in the case of an individual contract, are unfair, so that they can apply appropriate and effective means to prevent their use.

Parmi les moyens mentionnés au paragraphe 2 figurent des dispositions permettant aux organisations ayant, ou officiellement reconnues comme ayant, un intérêt légitime à représenter les entreprises de saisir, conformément aux législations nationales concernées, les juridictions ou les instances administratives compétentes, au motif que les conditions contractuelles ou les pratiques commerciales, y compris dans le cas d'un contrat individuel, sont abusives, de sorte qu'elles puissent recourir à des moyens appropriés et efficaces pour mettre fin à leur utilisation.
