– (FR) Mr President, I would like to thank all the committee members who worked alongside the rapporteur, Mrs Gál, on these areas, as well as all those MEPs who took the floor today in this House, thereby showing that fundamental rights are very important. I can only support what has already been said by several MEPs, namely that it is high time that we focused on fundamental rights within the European Union in order to be credible and be able to talk about fundamental rights outside the European Union.

Believes that EU action should not only address violations of fundamental rights after they have happened, but should also seek to prevent them; consequently calls for a reflection on mechanisms for early detection of potential violations of fundamental rights in the EU and in its Member States, temporary freezing of the measures which constitute such violations, accelerated legal procedures for determining if a measure is contrary to EU fundamental rights and for sanctions in the event that these measures are nonetheless implemented contrary to EU law;

In political terms accession means that the European Union reaffirms the pivotal role played by the Convention’s system for the protection of human rights in Europe – in an enlarged Europe, not only in the European Union – but by acceding to this Convention the European Union puts its weight behind the Strasbourg system, and this is a system of external judicial control in the area of fundamental rights because now we are submitting our legal order fully and formally to that control. This, of course, will enhance the credibility both internally and externally of the EU’s very strong commitment to fundamental rights.
Sur le plan politique, l’adhésion signifie que l’Union européenne réaffirme le rôle pivot qu’endosse le système de la Convention en matière de protection des droits de l’homme en Europe, dans une Europe élargie et non sur le seul territoire de l’Union. Any of these measures regarding end-users’ access to, or use of, services and applications through electronic communications networks liable to restrict those fundamental rights or freedoms may only be imposed if they are appropriate, proportionate and necessary within a democratic society, and their implementation shall be subject to adequate procedural safeguards in conformity with the European Convention for the Protection of Human Rights and Fundamental Freedoms and with general principles of Community law, including effective judicial protection and due process.

Authorisation should be granted only if standards equivalent to those provided for in this Directive are met. However, the important role played by existing European organ exchange organisations in the exchange of organs between the Member States and third countries participating in such organisations should be taken into account (16) This Directive should respect the fundamental rights and observe the principles recognised in particular by the Charter of Fundamental Rights of the European Union [11]. In line with that charter and to take account of, as appropriate the Convention on human rights and biomedicine [12], organ transplantation programmes should be founded on the principles of voluntary and unpaid donation, altruism of the donor and solidarity between donor and recipient while ensuring anonymity of the deceased donor and the recipient(s).

It also leads us to remind not only the Federal State of Nigeria, but also Niger, Sudan and Somalia, that the current interpretation and application of the sharia is not only a clear violation of fundamental rights, but that it evidently contravenes the international commitments to human rights which they have signed up to, including the Cotonou agreements, article one of which clearly states that the rights of the individual will be respected and that the situation of women and issues of sex equality will systematically be taken into account in all areas, political, economic and social.

In fact, we are entirely responsible for fundamental rights in Europe, while we can only take a humble approach to human rights in the world, knowing how little influence we can exert there.
