There have only been a few decisions concerning State aid to sport and, as in other sectors in a similar situation, stakeholders have repeatedly called for further clarification regarding the financing of infrastructure and sport organisations.

6. Believes that, due to the complexity of separating competition law aspects from purely sporting aspects, certain situations have to be dealt with on a case-by-case basis; therefore opposes any moves towards establishing a block exemption for sport as regards the EC competition rules and furthermore calls on the Commission to recognise that EC competition law is relevant only to the economic activities of sporting organisations;

Encourages the Commission to promote the implementation and strengthening of self-regulatory licensing systems at national and European level in order to increase good governance and to create a level playing field concerning financial transparency and stability; recommends that measures should be taken that lead to the achievement of financial transparency and cost control in European sport, to ensure not only stability but also a level playing field among European competitors in the sports sector; and recognises the benefit of organisers of national and European competitions granting licences to professional clubs to ensure that those clubs have the necessary structure and meet the required material conditions for taking part in competitions;
encourage la Commission à promouvoir l'application et le renforcement de systèmes de licence reposant sur l'autoréglementation, à l'échelon national et européen, afin d'accroître la bonne gouvernance et de créer des conditions égales pour tous en ce qui concerne la transparence financière et la stabilité; recommande que des mesures soient prises pour atteindre la transparence financière et le contrôle des coûts dans le sport européen, afin de garantir non seulement la stabilité mais aussi des conditions égales pour tous les concurrents européens dans le secteur du sport; reconnaît l'utilité de l'octroi de licences, par les organisateurs des compétitions aux niveaux national et européen, aux clubs professionnels, garantissant que ces derniers ont la structure nécessaire et répondent aux conditions matérielles requises pour participer aux compétitions;

Differential treatment can only be accepted if it is justified by a legitimate objective such as, for example protection of victims of sexual abuse (in the case of creating women’s refuges), freedom of association (in the context of membership of unisex private clubs) or organisation of unisex sporting activities.
Les différences de traitement ne peuvent être acceptées que si elles sont justifiées par un objectif légitime, comme par exemple la protection des victimes de violences à caractère sexuel (dans le cas de la création de foyers unisexes), la liberté d'association (dans le cadre de l'affiliation à des clubs privés unisexes) ou l'organisation d'activités sportives unisexes.

To put it another way, the Commission could only intervene in strict compliance with its competences, and in this field, the Commission can only intervene, in any event, with the aim of complementing and strengthening action taken by sports organisations and by Member States.
