In this, clearly very difficult, context for anyone trying to respond on NPS, two comments from the earlier EESC opinions appear relevant, namely that ‘a State’s response to a threat should not cause more harm than the threat it wishes to prevent’ (8) and, as on many other topics of concern to regulators, ‘policies should be based on data and evidence — and not the other way round (9)’.
