By application lodged at the Registry of the Court of Justice on 18 August 1995, Langnese-Iglo GmbH brought an appeal, pursuant to Article 49 of the EC Statute of the Court of Justice, against the judgment of the Court of First Instance of 8 June 1995 in Case T-7/93 Langnese-Iglo v Commission [1995] ECR II-1533 in which that Court dismissed in part its application for the annulment of Commission Decision 93/406/EEC of 23 December 1992 relating to a proceeding pursuant to Article 85 of the EEC Treaty against Langnese-Iglo GmbH (IV/34.072) (hereinafter 'the contested decision').

On 25 March 1992 the Commission imposed interim measures in order to prevent Langnese-Iglo GmbH and Schöller Lebensmittel GmbH Co. KG from enforcing contractual rights obliging retailers to purchase ice cream exclusively from them.
