A variety of stakeholders in the Member States may be involved, as senders or as addressees, in the transmission of information for the exchange of human organs, such as competent authorities, delegated bodies including European organ exchange organisations, procurement organisations and transplantation centres.
Dans les États membres, diverses parties prenantes telles que les autorités compétentes, les organismes délégués dont les organisations européennes d’échange d’organes, les organismes d’obtention et les centres de transplantation, sont susceptibles d’intervenir en tant qu’expéditeurs ou destinataires dans la transmission d’informations relatives à l’échange d’organes humains.

‘European organ exchange organisation’ means a non-profit organisation, whether public or private, dedicated to national and cross-border organ exchange, in which the majority of its member countries are Member States.

However, the important role played by existing European organ exchange organisations in the exchange of organs between the Member States and third countries participating in such organisations should be taken into account.

ORGAN EXCHANGE WITH THIRD COUNTRIES AND EUROPEAN ORGAN EXCHANGE ORGANISATIONS

2. The supervision of organ exchange with third countries may be delegated by the Member States to European organ exchange organisations.

‘European organ exchange organisation’ means a non-profit organisation, whether public or private, dedicated to national and cross-border organ exchange, in which the majority of its member countries are Member States;

Authorisation should be granted only if standards equivalent to those provided for in this Directive are met. However, the important role played by existing European organ exchange organisations in the exchange of organs between the Member States and third countries participating in such organisations should be taken into account (16) This Directive should respect the fundamental rights and observe the principles recognised in particular by the Charter of Fundamental Rights of the European Union [11]. In line with that charter and to take account of, as appropriate the Convention on human rights and biomedicine [12], organ transplantation programmes should be founded on the principles of voluntary and unpaid donation, altruism of the donor and solidarity between donor and recipient while ensuring anonymity of the deceased donor and the recipient(s).
Conformément à cette Charte et pour tenir compte comme il se doit de la Convention sur les droits de l'homme et la biomédecine[12], les programmes de transplantation d'organes doivent reposer sur les principes de don volontaire et non rémunéré, d'altruisme du donneur et de solidarité entre ce dernier et le receveur, tout en garantissant l'anonymat du donneur décédé et du ou des receveurs.

(f) ‘European organ exchange organisation‘ means a non-profit organisation, whether public or private, dedicated especially to cross-border organ exchange; the countries members of such an organisation are in their majority Member States of the Community;
