TRADUCTIONS EN CONTEXTE

(139) In view of the fact that, as underlined by the Court of Justice of the European Union, the right to the protection of personal data is not an absolute right, but must be considered in relation to its function in society and be balanced with other fundamental rights, in accordance with the principle of proportionality, this Regulation respects all fundamental rights and observes the principles recognised in the Charter of Fundamental Rights of the European Union as enshrined in the Treaties, notably the right to respect for private and family life, home and communications, the right to the protection of personal data, the freedom of thought, conscience and religion, the freedom of expression and information, the freedom to conduct a business, the right to an effective remedy and to a fair trial as well as cultural, religious and linguistic diversity.

At the same time – in view of the fact that, as underlined by the Court of Justice of the EU[24], the right to the protection of personal data is not an absolute right, but must be considered in relation to its function in society[25] and be balanced with other fundamental rights, in accordance with the principle of proportionality[26] – the Regulation will include explicit provisions that ensure the respect of other fundamental rights, such as freedom of expression and information, the right to defence, as well as of professional secrecy (such as for the legal profession), without prejudicing the status of churches under the laws of the Member States.
Parallèlement - compte tenu du fait, souligné par la Cour de justice de l'Union européenne[24], que le droit à la protection des données à caractère personnel n’apparaît pas comme une prérogative absolue, mais doit être pris en considération par rapport à sa fonction dans la société[25] et qu'il doit être mis en balance avec d'autres droits fondamentaux conformément au principe de proportionnalité[26] -, le nouveau règlement comprendra des dispositions expresses qui garantiront le respect d’autres droits fondamentaux tels que la liberté d’expression et d’information, le droit de se défendre ainsi que le droit au secret professionnel (notamment pour les professions juridiques) sans porter atteinte au statut des églises tel qu'il est défini dans les législations nationales.

Welcomes the Commission Communication on the Strategy for the effective implementation of the Charter of Fundamental Rights by the European Union referring among others to its preventing approach in the effective implementation, the importance of internal training on fundamental rights, the systematic check of the fundamental rights aspect of the Commission's impact assessments by the Impact Assessment Board, as well as the targeted communication measures tailored to various situations needed in this respect; furthermore welcomes the emphasis of the above-mentioned Commission Communication regarding the importance of the political criteria for accession laid down by the 1993 Copenhagen European Council requiring candidate countries to have stable institutions guaranteeing democracy, the rule of law, human rights and respect for and protection of minorities; the preservation of this criterion is supporting the protection of fundamental rights in the future Member States;
se félicite de la communication de la Commission sur la stratégie pour la mise en œuvre effective de la Charte des droits fondamentaux par l'Union européenne, qui fait notamment référence à son approche préventive dans le cadre de la mise en œuvre effective, à l'importance des actions de formation interne sur les droits fondamentaux, à la vérification systématique, par le Comité d’analyse d’impact, des aspects relatifs aux droits fondamentaux dans les analyses d’impact de la Commission, et aux actions de communication ciblée et adaptée aux différentes situations nécessaire dans ce domaine; se félicite également de l'accent que met la Commission dans sa communication susmentionnée sur l'importance des critères politiques pour l'adhésion établis par le Conseil européen de Copenhague en 1993, qui demandent que les pays candidats présentent des institutions stables garantissant la démocratie, la primauté du droit, les droits de l'homme, ainsi que le respect des minorités et leur protection; est d'avis que la préservation de ce critère favorise la protection des droits fondamentaux dans les futurs États membres;

Calls for respect of its right to democratic scrutiny based on the treaties; insists on the necessity of enhancing transparency and access to documents between EU institutions, in order to develop more effective interinstitutional cooperation, including accountability on matters related to fundamental rights; underlines its role in following up its resolutions related to fundamental rights in the EU and its role in evaluating the work of other EU institutions in terms of their action or inaction when assessing developments in the field (e.g. through annual reports), combining as it does political messages with a facts-based approach; underlines its right, enshrined in Article 218(10) TFEU, to be immediately and fully informed at all stages of the procedure for concluding international agreements between the Union and third countries or international organisations;

The report on the state of human rights presents us with a situation, in countries such as Iran, China or Russia, in Guantánamo and in other countries, such as Cuba, where the exercise of a fundamental right was not permitted. The issue in question was not permitting the group known as the ‘Damas de Blanco’ (Ladies in White) to come to accept the Sakharov Prize, to enter and to leave their own country; similar abuses occur in other countries, as is the case in Nicaragua and Venezuela, which will be the subject of a separate resolution, to be voted on tomorrow.
Le rapport nous présente la situation des droits de l’homme, dans des pays comme l’Iran, la Chine ou la Russie, à Guantánamo et dans d’autres pays, tels que Cuba, qui n’a pas permis l’exercice d’un droit fondamental, en l’occurrence celui d’autoriser le groupe des Damas de Blanco (Dames en blanc) à sortir de leur pays pour recevoir le Prix Sakharov qui leur avait été décerné; des abus similaires se produisent dans d’autres pays, comme au Nicaragua et au Venezuela, qui feront l’objet d’une résolution séparée qui sera portée aux voix demain.

(14) The Union observes the principles recognised by Article 6(2) of the Treaty on European Union and reflected in the Charter of Fundamental Rights of the European Union, notably Chapters II and VI thereof. Nothing in this Framework Decision may be interpreted as being intended to reduce or restrict fundamental rights or freedoms such as freedom of expression, assembly, or of association, freedom of the press and freedom of expression of other media, or the right to respect for private and family life, including the right to respect of the confidentiality of correspondence, which also covers the content of e-mail and other kinds of electronic correspondence.
(14) L’Union observe les principes reconnus par l’article 6, paragraphe 2, du traité sur l’Union européenne et réaffirmés par la charte des droits fondamentaux de l’Union européenne, notamment ses chapitres II et VI. Rien dans la présente décision-cadre ne peut être interprété comme visant à réduire ou à entraver des libertés ou des droits fondamentaux tels que la liberté de réunion, d’association ou d’expression, la liberté de la presse et la liberté d'expression des autres médias, ou le droit au respect de la vie privée et familiale, y compris le droit au respect de la confidentialité de la correspondance, qui recouvre également le contenu des courriels ou de toute autre forme de correspondance électronique.

Member States should ensure that actions under the Fund respect the obligations derived from fundamental rights, laid down in particular in the European Convention for the Protection of Human Rights and Fundamental Freedoms (the European Convention on Human Rights), the Charter of Fundamental Rights of the European Union, the Geneva Convention relating to the Status of Refugees of 28 July 1951 as supplemented by the New York Protocol of 31 January 1967, and other relevant international instruments, such as the 1989 United Nations Convention on the Rights of the Child, where applicable.
Les États membres devraient faire en sorte que les actions entreprises dans le cadre du Fonds respectent les obligations découlant des droits fondamentaux, établis notamment par la Convention européenne de sauvegarde des Droits de l'Homme et des libertés fondamentales (la Convention européenne des Droits de l'Homme), la Charte des droits fondamentaux de l'Union européenne, la Convention de Genève du 28 juillet 1951 relative au statut des réfugiés, telle que la complète le protocole de New York du 31 janvier 1967, ainsi que, le cas échéant, les autres instruments internationaux pertinents tels que la Convention des Nations unies de 1989 relative aux droits de l'enfant.

Human dignity must be included in the list in Article 3g(c) as the paramount and fundamental value to be protected. This addition to the values to be protected is in line with Article 1 of the Charter of Fundamental Rights of the European Union, in which human dignity is placed above all other values as an inviolable right.

Because, just like archaeologists who gradually go on digging up small items through small excavations and then put all of that information together to produce a map of a city that had been hidden and the precise whereabouts of which nobody knew, the Commission, with the invaluable support of other people, of NGOs, in cooperation with the Council of Europe etc., has managed to draw up that map, to uncover and bring to light that hidden city, which is a plan designed for the systematic violation of the fundamental rights of the citizens on the theoretical premise of protecting our fundamental rights; we should protect our rights and our security by violating the rights of others. That is the approach our work has been taking.

In the case of other social fundamental rights, there should be a link between the way fundamental rights are worded and the effects thereof on the individual.
