This Communication focuses on EU policy on the return of irregular migrants, which — together with efficient border management, effective sanctions against employers of irregularly staying third-country nationals, and the fight against smuggling and trafficking of human beings — is an important tool for facing the challenge of irregular migration, while fully ensuring respect for the fundamental rights and dignity of the individuals concerned, in line with the EU Charter of Fundamental Rights, the European Convention on Human Rights and all other relevant international human rights conventions.

whereas, despite accepting 182 of the 227 recommendations put forward by the UN Human Rights Council at its June 2014 periodic review, Vietnam rejected recommendations such as the release of political prisoners and people detained without charge or trial, legal reform to end political imprisonment, the creation of an independent national human rights institution and other steps aimed at promoting public participation; whereas, however, Vietnam has recently allowed international human rights groups to meet with representatives of the opposition and government officials for the first time since the end of the Vietnam War.

Stresses that the right to freedom of thought, conscience, religion or belief, as encapsulated in Article 18 of the Universal Declaration on Human Rights and other international human rights instruments, is a fundamental human right, interrelated with other human rights and fundamental freedoms, encompassing the right to believe or not to believe, the freedom to practise theistic, non-theistic or atheistic belief alike, either in private or public, alone or in a community with others, and the right to adopt, change and abandon or return to a belief of one‘s choice; calls for the EU to promote the right to freedom of religion or belief within international and regional fora and in bilateral relations with third countries;

Calls for greater policy coherence to be established at EU level by bringing public procurement, export credit, good governance, competition, development, trade, investment and other policies and agreements into conformity with the international human rights, social and environmental standards laid down in the relevant OECD and UN guidelines and principles; calls, in this connection, for cooperation with bodies representing employees, employers and consumers while drawing on relevant NHRI advice, such as the submission of the European Group of National Human Rights Institutions to the Commission on human rights and procurement; calls for meaningful and adequate impact assessments of legislative proposals for potential incoherence with the UN Guiding Principles, and insists on coordination with the UN Working Group on Business and Human Rights in order to avoid disparate and inconsistent interpretations of those Guiding Principles; recalls, while recognising the significance of the UN human rights framework for CSR, the importance of the Charter of Fundamental Rights of the European Union, including Article 16 thereof, which guarantees the fundamental right to conduct a business, a right that should be duly taken into account and serve as a reference to support CSR policies in the EU; underlines the importance of balancing the freedom to conduct business with other rights guaranteed by the Charter, as well as with internationally recognised CSR principles and guidelines; welcomes, in this connection, the efforts of the European Union Agency for Fundamental Rights (FRA) to collect evidence and expertise concerning the existence and interpretation of the freedom to conduct business;

50. Welcomes the special sessions of the UNHRC on the human rights situation in the east of the DRC, on the impact of the global economic and financial crises on the universal realisation and effective enjoyment of human rights, on the situation of human rights in Sri Lanka, and on the human rights situation in the Occupied Palestinian Territories and East Jerusalem; regrets that during the 12th session of the UNHRC on 16 October 2009 the EU Member States failed to come up with a single position with regard to the vote on the Goldstone report, with 4 Member States voting against, 2 abstaining and 2 being absent during the vote; calls on the Member States and all relevant EU institutions to achieve closer policy coordination in the HRC and other UN bodies; stresses that respect for international human rights law and international humanitarian law by all parties and under all circumstances is an essential prerequisite for achieving a just and lasting peace in the Middle East; urges all parties, therefore, to comply with the UNGA resolutions adopted on 5 November 2009 and 26 February 2010 by conducting investigations that meet international standards; calls on the HR/VP to ensure that those who have committed violations of international law are held accountable in accordance with the EU obligation under the Geneva Convention and the EU priority of combating impunity;
