Following the opinion of the Legal Service, whose representatives participated in the meetings of the Consultative Working Party examining the recast proposal, and in keeping with the recommendations of the draftsperson, the Committee on Legal Affairs considers that the proposal in question does not include any substantive changes other than those identified as such in the proposal and that, as regards the codification of the unchanged provisions of the earlier acts with those changes, the proposal contains a straightforward codification of the existing texts, without any change in their substance.

This is not an unreasonable question for developing countries to ask and therefore it is only when we get greater clarity and firmness about US intentions on farm subsidies that other questions will be easier to answer within the other agricultural pillars of the negotiation – market access and export competition – thus also allowing us to move on to the substantive negotiations in the other sectors of these talks.

(23) Although it is important to follow the principle that the law of the home Member State determines all the effects of reorganisation measures or winding-up proceedings, both procedural and substantive, it is also necessary to bear in mind that those effects may conflict with the rules normally applicable in the context of the economic and financial activity of the credit institution in question and its branches in other Member States.
(23) S'il est important de retenir le principe selon lequel la loi de l'État membre d'origine détermine tous les effets des mesures d'assainissement ou des procédures de liquidation, qu'ils soient procéduraux ou substantiels, il faut cependant prendre en considération que ces effets peuvent entrer en conflit avec les règles normalement applicables dans le cadre de l'activité économique et financière de l'établissement de crédit et de ses succursales dans les autres États membres.
