(9) In order to facilitate access to European patents with unitary effect, in particular for small and medium-sized enterprises, applicants who do not have a language in common with one of the official languages of the European Patent Office should be able to file their patent applications at the European Patent Office in any other official language of the Union.

All central industrial property offices, including those which do not perform searches in the course of a national patent granting procedure, can have an essential role under the enhanced partnership, inter alia by giving advice and support to potential patent applicants, in particular small and medium-sized enterprises, by receiving applications, by forwarding applications to the European Patent Office and by disseminating patent information.

We have therefore seen a number of courts and certain national patent offices, as well as the European Patent Office, committing the error of considering everything as technical, with the result that there are now 200 000 patents of this type, or more, in the USA, and 30 000 granted by the European Patent Office, notwithstanding Article 52, paragraph 2 of its basic charter, which stipulates that software programs are not patentable.

The amendment seeks to forestall the negative effects on existing innovative infrastructures in a number of European countries of having the treatment of cases centralised in the European Patent Office. Permitting the authorities to request the national patent authorities to carry out searches or investigations will enable the national patent authorities to retain their powers and know-how with a view to promoting innovation.
