It should be noted at the outset, first, that under Article 14(1)(a) of Council Regulation (EEC) No 1408/71 of 14 June 1971 on the application of social security schemes to employed persons, to self-employed persons and to members of their families moving within the Community, as amended and updated by Council Regulation (EEC) No 2001/83 of 2 June 1983, a person employed in the territory of a Member State by an undertaking to which he is normally attached who is posted by that undertaking to the territory of another Member State to work there for that undertaking is to continue to be subject to the legislation of the first Member State, provided that the anticipated duration of that work does not exceed 12 months and that he is not sent to replace another person who has completed his term of posting.

The TUC were of the opinion that the working hours provisions of the Directive would "reintroduce a modest level of regulation essential for the protection of young people at work" (The use of the word "reintroduce" was due to the fact that the provision in the Employment of Women, Young Persons and Children Act 1920 which prohibited the employment of young people on night work in industrial undertakings was repealed by the Employment Act 1989).

Article 13 (2) (c) shall apply subject to the following exceptions and circumstances: 1. A person employed by an undertaking to which he is normally attached, either in the territory of a Member State or on board a vessel flying the flag of a Member State, who is posted by that undertaking on board a vessel flying the flag of another Member State to perform work there for that undertaking shall, subject to the conditions provided in Article 14 (1), continue to be subject to the legislation of the first Member State.

In view of the situation on the Belgian labour market, the ESF assistance will provide support for: - anticipation based on a contractual policy with the social partners, giving preference to an intersectoral and regional approach to worker training and to supportive measures for training structures; - preventing staff affected by industrial change and changes in production systems from being excluded from the labour market because the current level or type of their qualifications is incompatible with the technical demands brought about by these changes; - adapting staff qualifications and skills to the tasks and division of responsibilities generated by the new forms of industrial organisation; - providing support for occupational mobility within or outside the undertaking and limiting any negative consequences for individuals which may result; - improving workers' access to training, particularly for persons employed in SMEs, and familiarising small businesses with the concept of training plans.
Compte tenu de la situation du marché du travail en Belgique, les interventions du FSE veulent se concrétiser par un soutien particulier en faveur : - d'une approche en matière d'anticipation qui repose sur une politique contractuelle avec les partenaires sociaux.
