Definition: Disorders of adult personality and behaviour that have developed in persons with no previous personality disorder following exposure to catastrophic or excessive prolonged stress, or following a severe psychiatric illness. These diagnoses should be made only when there is evidence of a definite and enduring change in a person's pattern of perceiving, relating to, or thinking about the environment and himself or herself. The personality change should be significant and be associated with inflexible and maladaptive behaviour not present before the pathogenic experience. The change should not be a direct manifestation of another mental disorder or a residual symptom of any antecedent mental disorder.
Définition: Cette catégorie concerne des anomalies de la personnalité et du comportement chez l'adulte, survenant en l'absence de troubles préalables de la personnalité et faisant suite à un facteur de stress, soit catastrophique, soit excessif et prolongé, ou à une maladie psychiatrique sévère. Ce diagnostic ne doit être porté que dans les cas où on a la preuve d'un changement manifeste et durable des modes de perception, de relation ou de pensée concernant l'environnement ou soi-même. La modification de la personnalité doit être significative et être associée à un comportement rigide et mal adapté, absent avant la survenue de l'événement pathogène. 44 (1) Where the Minister is satisfied, by such medical certificates or other documentary evidence as is presented to the Minister or as the Minister may require, that a person, by reason of infirmity, illness, insanity or other cause, is incapable of managing the person’s own affairs, an application for a benefit, for a division of unadjusted pensionable earnings under section 55 or 55.1 of the Act or for an assignment of a portion of a retirement pension under section 65.1 of the Act may be made on that person’s behalf by another person or by an agency if the Minister is satisfied that such other person or agency is authorized by or pursuant to a law of Canada or of a province to manage that person’s affairs or, where it appears to the Minister that there is no other person or agency so authorized, by any other person or agency approved by the Minister.

If the Minister or the Social Security Tribunal established under section 44 of the Department of Employment and Social Development Act is satisfied, on being presented with medical certificates or other written statements, that a person, by reason of infirmity, illness, insanity or other cause, is incapable of managing their affairs, a request for a reconsideration under subsection 81(1) or (1.1) of the Act or an appeal under section 82 of the Act or section 55 of the Department of Employment and Social Development Act may be made on the person’s behalf by another person or an agency if that other person or agency is authorized by or under a law of Canada or of a province to manage the person’s affairs or, if it appears to the Minister or the Social Security Tribunal that there is no other person or agency so authorized, if that other person or agency is considered to be qualified to do so by the Minister or the Social Security Tribunal, as the case may be.
74. (6) If, on complaint in writing by the interested person, the Agency finds that the railway company is not negotiating in good faith and the Agency considers that a sale, lease or other transfer of the railway line, or the company’s operating interest in the line, to the interested person for continued operation would be commercially fair and reasonable to the parties, the Agency may order the railway company to enter into an agreement with the interested person to effect the transfer and with respect to operating arrangements for the interchange of traffic, subject to the terms and conditions, including consideration, specified by the Agency.
