whereas on 3 May 2016 the Phnom Penh Municipal Court summoned Kem Sokha regarding a charge of criminal defamation, along with MPs Pin Ratana and Tok Vanchan, notwithstanding the fact that they enjoy immunity.

whereas on 23 September 2010 the opposition leader Sam Rainsy was sentenced in absentia to 10 years in prison on charges of disinformation and falsifying public documents by the Phnom Penh Municipal Court; whereas his conviction was based on an act of civil disobedience involving the uprooting of six wooden temporary border posts at the Vietnamese-Cambodian border, which is still disputed between the two countries; whereas the action took place in support of villagers who claimed to be victims of land-grabbing, saying that the Vietnamese had illegally shifted the posts onto Cambodian soil, in their rice fields, and that their complaints to the local authorities had remained unanswered,
considérant que, le 23 septembre 2010, Sam Rainsy a été condamné par contumace par le tribunal municipal de Phnom Penh à 10 ans de prison pour désinformation et falsification de documents publics, que sa condamnation est fondée sur un acte de désobéissance civile, qui a consisté à renverser six bornes en bois marquant temporairement la frontière que le Vietnam et le Cambodge se disputent encore, et que cet acte visait à soutenir des villageois qui affirmaient avoir été spoliés de leurs terres par les Vietnamiens, qui auraient déplacé en toute illégalité les bornes pour les implanter en territoire cambodgien, dans leurs champs de riz, et dont les plaintes auprès des autorités locales étaient restées vaines,
