32. Notwithstanding section 31, the rate of royalty may be altered by agreement between the Division Chief and the lessee from a rate based on a percentage of the gross revenue or of the market value to the equivalent rate per ton or per cubic yard of the mineral output at the pithead.

Nonobstant l’article 31, le taux des redevances pourra être modifié par une entente conclue entre le chef de la Division et le preneur, de façon à remplacer le taux calculé en fonction d’un pourcentage du revenu brut ou de la valeur marchande par un taux équivalent calculé à la tonne ou à la verge cube de production minière sur le carreau de la mine.
