Under Article 7(1) TEU, the Council must hear Poland's position and obtain the consent of the European Parliament (on the basis of Article 354 TFEU, the European Parliament shall act by a two-thirds majority of votes cast, representing the majority of its component Members), before adopting a Decision by a four-fifths majority (22 of 27 Members of the Council entitled to vote on the basis of Article 354 TFEU), determining that there is a clear risk of a serious breach of the rule of law.

In order to focus animal health control measures and to prevent the further spread of African swine fever, as well as to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to Implementing Decision 2014/709/EU should be amended to take into account the changes in the current epidemiological situation as regards that disease in Estonia, Lithuania and in Poland.
Pour cibler les mesures zoosanitaires, enrayer la propagation de la peste porcine africaine, prévenir toute perturbation inutile des échanges dans l'Union et éviter l'imposition, par des pays tiers, d'entraves non justifiées aux échanges commerciaux, la liste de l'Union des zones faisant l'objet des mesures zoosanitaires mentionnées à l'annexe de la décision d'exécution 2014/709/UE devrait être modifiée de manière à prendre en considération les changements survenus dans la situation zoosanitaire en ce qui concerne cette maladie dans les trois pays précités.

In order to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, it is necessary to establish in collaboration with the Member State concerned a Union list of the infected territories for African swine fever in Poland.
Pour prévenir toute perturbation inutile des échanges dans l’Union et éviter l’imposition par des pays tiers d’entraves non justifiées aux échanges commerciaux, il est nécessaire de dresser, à l’échelon de l’Union européenne, en collaboration avec l’État membre concerné, une liste des territoires infectés par la peste porcine africaine en Pologne.
