On 21 January 2014, the Commission adopted a statement of objections (‘SO’), in which it took the preliminary view that the Transaction would significantly impede effective competition in a substantial part of the internal market within the meaning of Article 2 of the Merger Regulation.

These developments are in line with statements in previous Committee opinions (2): ‘It will be necessary to work through the International Civil Aviation Organization (ICAO) in order to ensure the worldwide application of an Emissions Trading Scheme (ETS); as a practical first step, an intra-EU ETS could be a very feasible option, if this proves appropriate in the course of the negotiations’ (2006); ‘By bringing aviation within the remit of the European Emissions Trading Scheme (ETS) the scheme is itself potentially strengthened and made more robust as the pre-eminent model for tackling CO2 emissions at a global level’ (2007); and more recently ‘The Committee accordingly welcomes initiative, which provides for a moratorium on the application of the Emissions Trading Scheme (ETS) to airlines operating flights into and out of the European Economic Area, pending the completion of the global negotiations’ (2013).

Et plus récemment, en 2013: «Le Comité se félicite en conséquence de l'initiative prévoyant un moratoire sur l'application du système d'échange de quotas d'émission (SCEQE) aux compagnies aériennes, pour les vols à destination et en provenance de l'espace économique européen (EEE), dans l'attente de la conclusion des négociations internationales».

The Court also held that Freixenet could not invoke for that purpose and by analogy Case C-301/07 PAGO International [2009] ECR I-9429, which relates to a reference for a preliminary ruling concerning Article 9(1)(c) of Regulation No 40/94 and the question of the protection conferred by reputation to a Community trade mark which has already been registered.
