Brussels, 26 August 2011 - Against the background of the announcement by President Al Bashir of Sudan of a two-week unilateral cease-fire in South Kordofan, Kristalina Georgieva, the European Union Commissioner for International Cooperation, Humanitarian Aid and Crisis Response stated her grave concern about the impossibility to reach and assist the people in humanitarian emergency in the region.

On the issue of impunity with regard to President al-Bashir, how do you feel about the approach that is sometimes taken on this issue, which is that if al-Bashir will reconcile himself to the independence of the south, it will be a kind of a quid pro quo for him not being pursued with regard to his criminal indictments?

Years later, with all the imperfections that have attended its work, the ICC has nonetheless fulfilled its initial mandate and promise as exemplified in the indictment of President al-Bashir of Sudan for war crimes, crimes against humanity, and genocide, and the referral by the UN Security Council, supported by the government, of the cases of Colonel Gadhafi and Libyan leaders to the ICC for prospective investigation and prosecution.

B. whereas on 4 March 2009 the ICC issued an international warrant for the arrest of the President al-Bashir for crimes against humanity (murder, extermination, deportation, torture and rape) and war crimes (planning attacks on civilians and looting), and President al-Bashir is also the subject of an order of 12 July 2010 indicting him for ‘genocide by killing, genocide by causing serious bodily or mental harm and genocide by deliberately inflicting on each target group conditions of life calculated to bring about the group's physical destruction’,
B. considérant que le Président Umar al-Bachir fait l'objet d'un mandat d'arrêt international émis le 4 mars 2009 par la CPI pour crimes contre l'humanité (meurtre, extermination, déportation, torture et viol) et crimes de guerre (planification d'attaques contre des civils et pillages), ainsi que d'une ordonnance du 12 juillet 2010 l'inculpant pour «génocide par meurtre, génocide par atteinte grave à l'intégrité physique ou psychologique des victimes, et génocide par soumission intentionnelle de chacun de ces groupes à des conditions d'existence devant entraîner leur élimination physique»,

8. Calls for an end to impunity for all crimes perpetrated during the war in Sudan, and hopes that President al-Bashir will soon be brought to the ICC in The Hague – where he will benefit from rights granted by international law – as part of the necessary re-establishment of justice, the rule of law and respect for the victims of such crimes;

As I said in my earlier comments, there is nothing that should prevent Canada from strongly signalling to President al-Bashir that we will not hesitate to use those available troops, that capacity, to back up a UN mission, but use every bit of diplomatic effort available to make that unnecessary because we need to get President al-Bashir to respond to the global pressure and the growing horrors about the genocide in slow motion that is happening in Darfur.
Pour reprendre ce que j'ai dit plus tôt, rien n'empêche le Canada de faire clairement savoir au président al-Bechir que nous n'hésiterons pas à déployer les militaires canadiens disponibles, notre capacité militaire, pour appuyer une mission de l'ONU, tout en faisant tous les efforts diplomatiques possibles pour ne pas avoir à en arriver là, car il faut inciter le président al-Bashir à réagir aux pressions internationales et aux horreurs qui se multiplient dans le contexte du génocide qui est en train de se perpétrer petit à petit au Darfour.
