The General Court erred in its judgment in so far as (i) it was inconsistent with previous judgments handed down on the same question (T-332/06 and C-194/09 P); (ii) when applying Article 107(1) TFEU, it confused two criteria, both necessary to prove the existence of aid, inferring that an advantage was conferred on Alcoa from the mere finding that the resources used were of State origin; (iii) it failed to provide an adequate statement of reasons in so far as it failed to observe that the Commission had erred in assuming that Alcoa had obtained an advantage from the measure and had not, therefore, to that end, carried out a proper economic analysis to calculate the extent of the advantage in this particular case.
L’arrêt du Tribunal est erroné en ce que: i) il contredit des décisions antérieures rendues sur la même question (T-332/06 et C-194/09 P); ii) en faisant application de l’article 107, paragraphe 1, TFUE, il confond deux critères, qui sont tous deux nécessaires pour qu’il y ait une aide, en faisant découler l’existence d’un avantage pour Alcoa de la simple constatation du caractère étatique des ressources qui ont été employées; iii) il est dépourvu d’une motivation appropriée dès lors qu’il n’a pas relevé que la Commission avait présumé à tort que la mesure procurait un avantage à Alcoa et n’avait donc pas effectué d’analyse économique appropriée pour apprécier, le cas échéant, la valeur de cet avantage.

Points out that, in its judgment of 10 September 2009 in Case C-573/07, the CJEU found that the mere possibility of opening up the capital of a previously publicly-owned company to private investors may not be taken into consideration as a factor making competitive tendering a requirement unless the character of the public capital company changes during the period for which the contract is valid, thereby altering the fundamental conditions of the contract and necessitating a new competitive tender; notes that there have been major developments in relation to the rules in the area of public-public cooperation as a result of the CJEU's case-law, and welcomes the recent judgements handed down by the Court in this area; calls, therefore, on the Commission and the Member States to make information about the legal implications of these judgments widely available;

Notes on the one hand the previous Commission's efforts, pursuant to the provisions of Article 29 of Directive 2005/85/EC, to draw up a list of safe countries of origin, but recalls on the other hand the pending judgment of the action for annulment which was brought before the Court of Justice concerning that Directive, for which reason the drafting of such a list is currently suspended; and calls on the Council to take into account these contrasting elements and to make decisions accordingly; points out, furthermore, that the safe third country concept does not exempt Member States from their obligations under international law, in particular the provisions laid down in the Geneva Convention concerning the principle of non-refoulement and the individual assessment of every single application for asylum;
14. constate les efforts déployés par la Commission, conformément aux dispositions de l'article 29 de la directive 2005/85/CE, pour établir une liste des pays d'origine sûrs, non sans rappeler que la Cour doit encore se prononcer sur le recours en annulation introduit contre cette directive, ce qui explique que l'établissement de la liste est suspendu, et invite le Conseil à tenir compte de ces éléments et à prendre ses décisions en conséquence; rappelle par ailleurs que la notion de pays tiers sûr n'exonère pas les États membres des obligations que leur impose le droit international, notamment les dispositions de la convention de Genève relatives aux principes de non-refoulement et d'examen individuel de chaque demande d'asile;
