This international treaty provides a framework, based on the precautionary principle, for the safe transfer, handling and use of living modified organisms (LMOs) resulting from modern biotechnology that may have adverse effects on the conservation and sustainable use of biological diversity, or pose risks to human health.
Ce traité international constitue un cadre, fondé sur le principe de précaution, qui vise à garantir le transfert, la manipulation et l'utilisation sans danger des organismes vivants modifiés (OVM) résultant de la biotechnologie moderne qui peuvent avoir des effets dommageables sur la conservation et l'utilisation durable de la diversité biologique ou qui présentent un risque pour la santé humaine.

1. The Commission shall ensure that where safe and technologically- and economically-viable alternatives are available on the market, the quantity of hydrofluorocarbons that producers and importers are entitled to place on the market in the Union each year does not exceed the maximum quantity for the year in question calculated in accordance with Annex V. Considers that the Deepwater Horizon oil spill in the Gulf of Mexico must lead the EU urgently, and where necessary, to carry out an in-depth review of both their appropriate legislation and regulation, in respect of the precautionary principle and on the principle that preventive action should be taken, on all aspects of offshore oil and gas extraction and exploration, including safe transfer by underwater pipelines located on/under the seabed, in its territories; in this context, welcomes the Commission's will urgently to fill gaps in existing EU legislation;

In accordance with the precautionary principle, and without prejudice to the provisions of Directive 2001/18/EC, the objectives of this Regulation are to establish a common system of notification and information for transboundary movements of genetically modified organisms (GMOs) and to ensure coherent implementation of the provisions of the Protocol on behalf of the Community in order to contribute to ensuring an adequate level of protection in the field of the safe transfer, handling and use of GMOs that may have adverse effects on the conservation and sustainable use of biological diversity, taking also into account risks to human health.
Conformément au principe de précaution et sans préjudice des dispositions de la directive 2001/18/CE, le présent règlement a pour objectifs de mettre en place un système commun de notification et d'information concernant les mouvements transfrontières d'organismes génétiquement modifiés (OGM) et de garantir une mise en oeuvre cohérente des dispositions du protocole au nom de la Communauté, afin de contribuer à assurer un niveau adéquat de protection pour le transfert, la manutention et l'utilisation sans danger des OGM qui peuvent avoir des effets défavorables sur la conservation et l'utilisation durable de la diversité biologique, en tenant compte également des risques pour la santé humaine.

(2) Article 1 of the Protocol specifies that, in accordance with the precautionary approach contained in Principle 15 of the Rio Declaration on Environment and Development, the objective of the Protocol is to contribute to ensuring an adequate level of protection in the field of safe transfer, handling and use of genetically modified organisms (GMOs) resulting from modern biotechnology that may have adverse effects on the conservation and sustainable use of biological diversity, taking also into account risks to human health and specifically focusing on transboundary movements.
(2) L'article 1er du protocole spécifie que, conformément à l'approche de précaution consacrée par le principe 15 de la déclaration de Rio sur l'environnement et le développement, l'objectif du protocole est de contribuer à assurer un niveau adéquat de protection pour le transfert, la manutention et l'utilisation sans danger des organismes génétiquement modifiés (OGM) résultant de la biotechnologie moderne qui peuvent avoir des effets défavorables sur la conservation et l'utilisation durable de la diversité biologique, compte tenu également des risques pour la santé humaine, en mettant plus précisément l'accent sur les mouvements transfrontières.

Recently, on 28 January 2000, at the Conference of the Parties to the Convention on Biological diversity, the Protocol on Biosafety concerning the safe transfer, handling and use of living modified organisms resulting from modern biotechnology confirmed the key function of the Precautionary Principle.
Dans le Protocole sur la Biosécurité, adopté à Montréal le 28 janvier 2000, la Conférence des Parties à la convention sur la diversité biologique a expressément reconnu dans son article 10 paragraphe 6 le recours au principe de précaution.
