This Directive shall only apply to transactions, orders or behaviours which would fall within Regulation (EU) Noof the European Parliament and the Council on insider dealing and market manipulation and which would be prohibited under that Regulation.
La présente directive ne s'applique qu'aux transactions, ordres ou comportements qui relèveraient du règlement (UE) n° .du Parlement européen et du Conseil sur les opérations d'initiés et les manipulations de marché et qui seraient interdits en vertu de ce règlement.

4. For other Joint Committee decisions concerning matters that fall within regulations and directives that are incorporated in the Agreement on the European Economic Area, the position to be taken by Iceland and Norway shall be adopted by Iceland and Norway on a proposal from the Commission.

(43) The Commission should be empowered to adopt delegated acts in accordance with Article 290 TFEU in respect of the criteria according to which foods may be considered as having been used for human consumption to a significant degree within the Union before 15 May 1997, in respect of the determination of whether a type of food falls within the scope of this Regulation, the adjustment and adaptation of the definition of ‘engineered nanomaterial’ to technical and scientific progress and in line with definitions subsequently agreed at international level, rules on how to proceed in cases in which the Commission has no information about use of a food for human consumption before 15 May 1997, as well as in respect of rules for the application of Article 4(1) and Article 9 and the update of the Union list . It is of particular importance that the Commission carry out appropriate consultations during its preparatory work, including at expert level ,

Therefore, food used solely as additives falling within the scope of Regulation (EC) No 1333/2008 of the European Parliament and of the Council of 16 December 2008 on food additives, flavourings falling within the scope of Regulation (EC) No 1334/2008 of the European Parliament and of the Council of 16 December 2008 on flavourings and certain food ingredients with flavouring properties for use in and on foods, extraction solvents falling within the scope of Directive 2009/32/EC of the European Parliament and of the Council of 23 April 2009 on the approximation of the laws of the Member States on extraction solvents used in the production of foodstuffs and food ingredients (recast), enzymes falling within the scope of Regulation (EC) No 1332/2008 of the European Parliament and of the Council of 16 December 2008 on food enzymes and genetically modified food falling within the scope of Regulation (EC) No 1829/2003 of the European Parliament and of the Council of 22 September 2003 on genetically modified food and feed should be excluded from the scope of this Regulation.

Because subsistence hunting (as that term is normally and properly understood) by its nature involves personal or family consumption only, and does not involve placing seal products on the market or importing or exporting them, seal products from these subsistence hunts do not fall within the Regulation, which deals with international trade.

During the period referred to in Article 10(1) of Regulation (EC) No 1260/2001, C sugar referred to in Article 13 of that Regulation, exported in accordance with the relevant provisions of Commission Regulation (EEC) No 2670/81 of 14 September 1981 laying down detailed implementing rules in respect of sugar production in excess of the quota and brought in to be consumed in Madeira and in the Canary Islands in the form of white sugar falling within CN code 1701 and to be refined and consumed in the Azores in the form of raw sugar falling within CN code 1701 12 10, shall benefit, under the conditions set out in this Regulation, from the exemption from import duties within the limit of the forecast supply balance referred to in Article 2 of this Regulation.

Pendant la période visée à l’article 10, paragraphe 1, du règlement (CE) no 1260/2001, le sucre C visé à l’article 13 dudit règlement, exporté conformément aux dispositions pertinentes du règlement (CEE) no 2670/81 de la Commission du 14 septembre 1981 établissant les modalités d’application pour la production hors quota dans le secteur du sucre , et introduit pour y être consommé à Madère et aux îles Canaries sous forme de sucre blanc relevant du code NC 1701 et pour être raffiné et consommé aux Açores sous forme de sucre brut relevant du code NC 1701 12 10, bénéficie, dans les conditions fixées par le présent règlement, du régime d’exonération des droits d’importation dans la limite des bilans prévisionnels d’approvisionnement visés à l’article 2 du présent règlement.

In order to take account both of the emergence of new therapies and of the growing number of so-called "borderline" products between the medicinal product sector and other sectors, the definition of "medicinal product" should be modified so as to avoid any doubt as to the applicable legislation when a product, whilst fully falling within the definition of a medicinal product, may also fall within the definition of other regulated products.
Afin de prendre en compte, d'une part, l'émergence de nouvelles thérapies et, d'autre part, le nombre croissant de produits dits "frontière" entre le secteur des médicaments et les autres secteurs, il convient de modifier la définition du médicament pour éviter, lorsqu'un produit répond pleinement à la définition du médicament, mais pourrait aussi répondre à la définition d'autres produits réglementés, que subsiste un doute sur la législation applicable.
