(4) In order to ensure free circulation of publications such as periodicals, newspapers and magazines throughout the Internal Market and avoid any risk of obstacles to free movement as a result of Member States’ laws, regulations and administrative provisions which prohibit or regulate tobacco advertising in those media, it is necessary to clarify the legal situation by providing that Member States may limit tobacco advertising therein to those magazines and periodicals which are not intended for the general public such as trade journals, but may not prohibit the sale and circulation of publications which are published in other Member States, where those publications are not principally intended for the market of that Member State.
