Member States have made substantial efforts to comply with this requirement and the quality of the economic analyses submitted with project applications has improved. However, further progress remains to be made, in particular in the case of environment projects.

2.2.7 The provision which is more frequently concerned in infringement procedures on EIA Directive is Article 4(2) in particular as regards 1) the "screening" in itself, 2) the application of the thresholds, and 3) the listing of the projects of Annex II. Both under the old and the new version of the Directive, the assessment of the characteristics of Annex II projects (in order to determine, in individual cases, whether the project is to be made the subject of an EIA) is often not correctly carried out (this is a case of wrong application).

Coordinated efforts are also being made to ensure the best possible exploitation of the project results from the 6th Framework Programme (the main common objective of these application projects - four on service prototypes and sixteen on user communities during the period 2004-2008 - was to demonstrate the added value of EGNOS and Galileo, to offer support in the Galileo mission definition and to identify main areas of interest for user communities where EGNOS/Galileo applications would have an impact).

Under the provisions for 2000-06, unlike the previous arrangement of permanent advances, the Commission reimburses the payments made by beneficiaries, i.e. after the calls for expressions of interest, the consideration of applications, the selection of projects to finance, the making of grants, calls for tenders, the start of projects, payments, checks and the declaration to the Commission, which has 60 days in which to make the payment.

In exercising the powers and performing the duties and functions relating to terms and conditions that are to apply in respect of a project, the responsible Minister must not accept or impose terms and conditions that would be inconsistent with any standard established by any environmental or socio-economic Act of Parliament of general application or territorial law of general application or by any regulation of general application made under such an Act or law.

2. Applications for major projects within the meaning of Articles 39, 40 and 41 of Regulation (EC) No 1083/2006 made to the Commission under Regulation (EC) No 1164/94 shall remain valid provided that such applications are supplemented, where necessary, so as to comply with the requirements of this Regulation and the abovementioned Articles of Regulation (EC) No 1083/2006 within not more than two months as of 1 January 2007.
2. Les demandes relatives à de grands projets, au sens des articles 39, 40 et 41 du règlement (CE) no 1083/2006, introduites auprès de la Commission au titre du règlement (CE) no 1164/94 restent valables, pour autant qu'elles soient complétées, en tant que de besoin, de façon à les rendre conformes aux exigences du présent règlement et aux articles susmentionnés du règlement (CE) no 1083/2006, dans un délai maximal de deux mois à compter du 1er janvier 2007.

To do this, we have made the following suggestions to the government: to reopen the ecoENERGY for Biofuels Program to renewable diesel funds to new project applications; ask existing program projects that are currently not producing or have not substantially completed construction to reapply; and ensuring the transparent, timely and prompt window for new application submission selections and approvals.
