8. 12. Reaffirms paragraph 2 of its abovementioned resolution of 16 May 2000 on protecting the Communities' financial interests and calls on the Commission, as a preliminary step, to present, on the basis of the current Article 280 of the EC Treaty, a proposal to extend Regulation (EC) No 1073/1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF) , which would allow the early appointment of such a public prosecutor, whose jurisdiction would be limited, pending the entry into force of the envisaged changes to the Treaty, to criminal offences against the financial interests of the European Communities committed by members and employees of the EU institutions and who would have the task of heading the related OLAF investigations and facilitating the prosecution of such criminal offences in the appropriate national courts;
12. réaffirme la teneur du paragraphe 2 de sa résolution précitée du 16 mai 2000, et invite la Commission à présenter, à titre de première étape, sur la base de l'article 280 du traité CE, une proposition qui, complétant le règlement (CE) nº 1073/1999 relatif aux enquêtes de l'OLAF , permettrait de désigner rapidement un procureur européen dont, jusqu'à l'entrée en vigueur de la modification du traité, la compétence serait limitée aux délits commis par des membres et des agents des institutions de l'Union européenne au détriment des intérêts financiers des Communautés européennes, et qui aurait pour mission de conduire les enquêtes menées par l'OLAF concernant ces délits et de faciliter, à leur propos, les poursuites devant les juridictions nationales appropriées;

Calls on the Commission, as a preliminary step and in anticipation of such a European public prosecutor's office, to present by 30 June 2000 at the latest, on the basis of Article 280 of the EC Treaty, in accordance with the corresponding proposals made by the Committee of Independent Experts, a proposal to extend the OLAF Regulation , which would allow the early appointment of such a public prosecutor, whose jurisdiction would be limited, pending the entry into force of the envisaged changes to the Treaty, to criminal offences against the financial interests of the European Communities committed by members and employees of the EU institutions and who would have the task of heading the related OLAF investigations and facilitating the prosecution of such criminal offences in the appropriate national courts;
2. invite la Commission à présenter, pour le 30 juin 2000 au plus tard, sur la base de l'article 280 du traité CE, à titre de première étape dans la voie de la création de ce ministère public européen et conformément aux propositions faites à cet égard par le comité d'experts indépendants, une proposition qui, complétant le règlement instituant l'OLAF , permettrait de désigner rapidement un procureur européen, dont, jusqu'à l'entrée en vigueur de la modification du traité, la compétence serait limitée aux délits commis par des membres et des agents des institutions de l'Union européenne au détriment des intérêts financiers des Communautés européennes et qui aurait pour mission de conduire les enquêtes menées par l'OLAF concernant ces délits et de faciliter, à leur propos, les poursuites devant les juridictions nationales appropriées;

Welcomes the Commission's support for the idea of a European Public Prosecutor and expects the Commission in the Green Paper it has announced also to examine how, in accordance with paragraph 8 of its Resolution of 14 March 2001 on the 1999 report on the fight against fraud, a European Public Prosecutor's Office for financial matters can be set up on the basis of the EU Treaty whose jurisdiction would be limited initially to internal investigations and which would have a purely advisory and supporting role vis-à-vis the national judicial authorities without any authority to issue instructions; points out that the call to set up such an office, whose remit would initially be confined to internal investigations, is endorsed by the OLAF Supervisory Committee in its latest progress report and cited as one of the preconditions for ensuring the legality and legitimacy of OLAF's investigations;
24. se félicite du soutien de la Commission à l'idée d'un procureur européen et escompte que la Commission, dans le livre vert qu'elle a annoncé, abordera la question des mesures à prendre pour parvenir, conformément au paragraphe 8 de sa résolution du 14 mars 2001 sur le rapport 1999 concernant la lutte contre la fraude, et sur la base du traité CE, à la création d'un procureur européen en matière financière, qui, dans un premier temps, ne serait compétent que pour les enquêtes internes et n'aurait vis-à-vis des autorités judiciaires nationales qu'un rôle de consultation et de soutien, sans compétence pour leur donner des instructions; souligne que le comité de surveillance de l'OLAF approuve, dans son dernier rapport d'activités, la demande de création d'un tel procureur, dont les compétences seraient limitées, dans un premier temps, à des enquêtes internes, et cite cette mesure comme une des conditions permettant de garantir la légalité et la légitimité des enquêtes de l'OLAF;
