In order to guarantee the protection of the rights of farmers, the power to adopt certain acts should be delegated to the Commission in respect of laying down criteria for determining the cases where a farmer's agricultural area is to be considered to be mainly an area naturally kept in a state suitable for grazing or cultivation, criteria to establish the distinction between receipts resulting from agricultural and from non-agricultural activities and the amount of direct payments relevant for applying the marginality test, and criteria to be met by farmers in order to prove that their agricultural activity is not marginal.

Finally, the effects conferred by the European patent with unitary effect shall not extend to the use of the patented invention on board vessels, aircrafts or land vehicles of countries other than participating Member States, when such vessels, aircrafts or vehicles temporarily or accidentally enter the waters of participating Member States and to the use by a farmer of protected livestock for farming purposes, on condition that the breeding animals or other animal reproductive material was sold or otherwise commercialised to the farmer by the patent proprietor or with his consent.

However, a number of limitations of the patent proprietor's rights should enable third parties to use the invention, for instance for private and for non-commercial purposes, for experimental purposes, for acts allowed specifically under Union law (in the area of veterinary medicinal products, medicinal products for human use, plant variety rights, the legal protection of computer programs by copyright and the legal protection of biotechnological inventions) under international law and for the use by a farmer of protected livestock for farming purposes.

However, the obligation for farmers set out in paragraphs 1 and 2 shall not apply where farmers created land under permanent pasture in the framework of programmes in accordance with Council Regulations (EEC) No 2078/92 of 30 June 1992 on agricultural production methods compatible with the requirements of the protection of the environment and the maintenance of the countryside (13) and (EC) No 1257/1999 of 17 May 1999 on support for rural development from the European Agricultural Guidance and Guarantee Fund (EAGGF) and amending and repealing certain Regulations (14) and Council Regulation (EC) No 1017/94 of 26 April 1994 concerning the conversion of land currently under arable crops to extensive livestock farming in Portugal (15).

Toutefois, les obligations établies aux paragraphes 1 et 2 ne s'appliquent pas dans le cas où des agriculteurs ont affectées des terres aux pâturages permanents dans le cadre de programmes conformes au règlements (CE) no 2078/92 du Conseil du 30 juin 1992 concernant des méthodes de production agricole compatibles avec les exigences de la protection de l'environnement ainsi que l'entretien de l'espace naturel (13), au règlement (CE) no 1257/1999 du Conseil du 17 mai 1999 concernant le soutien au développement rural par le Fonds européen d'orientation et de garantie agricole (FEOGA) et modifiant et abrogeant certains règlements (14) et au règlement (CE) no 1017/94 du Conseil du 26 avril 1994 concernant la conversion de terres actuellement consacrées aux cultures arables vers la production extensive de bétail au Portugal (15).
