In the early decades of the 20th century, a substantial modernisation of the island's agriculture took place, which also concerned artichoke production, with the move away from supplying the local market towards specialised production aimed at the Italian and international markets. It was in this period of major changes in trade that the ‘Carciofo Spinoso di Sardegna’ made its name and on the markets of the mainland the artichoke was most definitely not marketed indistinctly or anonymously; its Sardinian provenance has represented a guarantee of quality and of origin since the early years of the 20th century, one which is appreciated and sought out by consumers, as is apparent from numerous sources. The historical origin of the product has prompted consumers over time to identify the ‘Carciofo Spinoso di Sardegna’ with the image of Sardinia itself, to the extent that it has entered into common parlance and ‘Carciofo Spinoso di Sardegna’ can be found on the menus of various restaurants, on product labels and in commercial documents; this is why the need has arisen to place formal rules on the use of the designation, in order to make the link between the product's characteristics and the territory of Sardinia inseparable and to protect consumers and producers from any incorrect and undue use of the name.

(2) Whereas the marketing of goods infringing patents or supplementary protection certificates for medicinal products as provided for in Council Regulation (EEC) No 1768/92 of 18 June 1992 concerning the creation of a supplementary protection certificate for medicinal products (5) or supplementary protection certificates for plant protection products, as provided for in Regulation (EC) No 1610/96 of the European Parliament and of the Council of 23 July 1996 concerning the creation of a supplementary protection certificate for plant protection products (6) causes serious injury to their holders and constitutes an unfair and unlawful business activity; whereas such goods should as far as possible be prevented from being placed on the market and measures should be adopted to that end to deal effectively with this unlawful activity without impeding the freedom of legitimate trade; whereas this objective is also being pursued through efforts being made along the same lines at international level;
(2) considérant que la commercialisation de marchandises portant atteinte à des brevets ou à des certificats complémentaires de protection pour les médicaments, tels que prévus par le règlement (CEE) n° 1768/92 du Conseil du 18 juin 1992 concernant la création d'un certificat complémentaire de protection pour les médicaments (5), ou à des certificats complémentaires de protection pour les produits phytopharmaceutiques, tels que prévus par le règlement (CE) n° 1610/96 du Parlement européen et du Conseil du 23 juillet 1996 concernant la création d'un certificat complémentaire de protection pour les produits phytopharmaceutiques (6) porte un préjudice grave à leurs titulaires et constitue une activité commerciale déloyale et illégale; qu'il convient d'empêcher, dans toute la mesure du possible, la mise sur le marché de telles marchandises et d'adopter à cette fin des mesures permettant de faire face efficacement à cette activité illégale sans pour autant entraver la liberté du commerce légitime; que cet objectif rejoint d'ailleurs les efforts entrepris dans le même sens au plan international;
