Recalls that the EU has ratified the 2005 UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions and calls on the Member States who have not already done so to ratify the 1970 Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property, and the 1950 UNIDROIT Convention on Stolen and Illegally Exported Cultural Objects, which represent important tools for strengthening the protection of global cultural heritage and cultural diversity, as well as the 1954 Convention for the Protection of Cultural Property in the Event of Armed Conflict and its two protocols, the 2001 UNESCO Convention on the Protection of the Underwater Cultural Heritage and the 2003 UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage; calls for the harmonisation of legislation and an international agreement on cultural heritage and illicit trafficking;

However, the free movement of goods is not the only issue at stake here - the proposal also concerns the protection of cultural heritage. A reference to Article 167 TFEU on Union action in the cultural sphere, and in particular to paragraph 2 of that article, which deals with the conservation and safeguarding of cultural heritage of European significance, which include national treasures, and cooperation between the Member States would thus have cleared the way for an approach more consistent with the EU's ambitions in the cultural sphere.

In addition to protection of primeval forest, wooded areas, biodiversity, the ecosystem and the environment, promoting fair trade and combating climate change, the EU has in its various directives also committed itself to the protection of human rights, the protection of cultural heritage, sustainable regional development, sustainable rural development and combating poverty.

The Parties, in conformity with their respective legislation and without prejudice to the reservations included in their commitments in the other provisions of this Agreement, shall encourage, in the framework of appropriate programmes, exchanges of expertise and best practices regarding the protection of cultural heritage sites and historic monuments bearing in mind the UNESCO world heritage mission, including through facilitating the exchange of experts, collaboration on professional training, awareness of the local public and counselling on the protection of the historic monuments and protected spaces and on the legislation and implementation of measures related to heritage, in particular its integration into local life.

I. whereas most of the Member States and the Commission take the view, however, that both Directive 93/7/EEC and Regulation (EEC) No 3911/92 have already had a positive effect on the protection of cultural goods, by raising awareness of the protection of national cultural treasures among those involved in international trade and prompting a realisation of the importance of protecting cultural goods at European level,

– (FR) Mr President, I feel that the protection of cultural and natural heritage – quite apart from the matter of who is responsible for what under the Treaty – is of importance to everyone, because – let me say this before getting to the heart of the matter – like you, I consider that our heritage is made up of buildings, natural sites and traditions and cannot be restricted to one person, one region, or one country as it belongs to the entire community of European citizens.

* Most Member States take the view that the Regulation has had a positive impact on the protection of cultural goods, if only by virtue of raising awareness among the various parties (public administrations, private organisations and operators involved in various capacities in the fields of culture and art) and a growing realisation of the importance of protecting national cultural heritage.
* La plupart des Etats membres estiment, en effet, que le règlement a eu une influence positive sur la protection des biens culturels, ne fût-ce que du fait d'une plus grande sensibilisation des différents acteurs (administrations publiques, organismes privés et opérateurs intervenant différemment dans le domaine de la culture et de l'art) et d'une prise de conscience de l'importance qu'il y a de protéger les patrimoines culturels nationaux.

The effectiveness of customs controls on the export of cultural goods to a third country varies according to the Member State's attitude and behaviour as regards various aspects of culture and art. It is plain, therefore, that although the Regulation has successfully standardised the formalities and documentation needed at Community level for the export of cultural goods, this has not been matched by any real change in behaviour and attitudes on the question of genuine protection for cultural goods at Community level.
L'efficacité des contrôles douaniers sur l'exportation des biens culturels vers les pays tiers varie en fonction de l'attitude et du comportement des Etats membres vis-à-vis des différents aspects de la culture et de l'art. Il est donc évident que, si le règlement a réussi à uniformiser au niveau communautaire les formalités et la documentation nécessaires à l'exportation des biens culturels, il n'a pas été accompagné par un réel changement des comportements et des attitudes en faveur d'une véritable protection communautaire des biens culturels.
