L. whereas the Azerbaijani authorities have not taken into account the opinions of the Council of Europe’s European Commission for Democracy through Law (the Venice Commission) on the laws relating to freedom of association, political parties and protection from defamation; whereas, furthermore, they have not given due consideration to the findings of the Council of Europe’s Commissioner for Human Rights in his visits to the country;
L. considérant que les autorités azerbaïdjanaises n'ont pas tenu compte des avis de la Commission européenne pour la démocratie par le droit du Conseil de l'Europe (Commission de Venise) quant aux lois relatives à la liberté d'association, aux partis politique et à la protection contre la diffamation; qu'elles n'ont pas, en outre, tenu compte comme il se devait des constations formulées par le commissaire aux droits de l'homme du Conseil de l'Europe lors de sa visite en Azerbaïdjan;

T. whereas whistleblowers are vital in exposing corruption, fraud, mismanagement and human rights abuses, despite high personal risk, and whereas lack of protection against retaliation, controls on information, libel and defamation laws, and inadequate investigation of whistleblowers’ claims can all deter people from speaking out, and can often compromise their personal safety as well as that of their families; whereas the EU has a duty to protect them, in particular by making the most effective use possible of cooperation instruments such as the European Instrument for Democracy and Human Rights (EIDHR);

Underlines that free, unbiased, strong and independent media, in line with international media standards guaranteeing freedom of speech and access to information, are a cornerstone of democracy; calls, to this end, on the Government to establish an appropriate legal framework and to ensure its effective implementation, including putting an end to defamation as a criminal offence; notes with concern the ongoing political interference in the work of media, and urges the authorities to take immediate steps to protect journalists from threats and other pressures in their work, including by means of selective use of state advertising allocations, in order to promote independent and pluralistic media and thereby provide the citizens of Kosovo with access to information; calls for the protection of journalists and for the establishment of minimum working rights and conditions for journalists; calls for measures to ensure transparency in media ownership and to ensure the financial and editorial independence of the public broadcaster, i.a. by apportioning an appropriate share – such as 20 %, – of its programming, including current affairs programs, to independent producers;
41. souligne que l'existence de médias libres, impartiaux, forts et indépendants, conformément aux normes internationales en matière de médias garantissant la liberté d'expression et l'accès à l'information, constitue l'un des piliers de la démocratie; invite à cet égard le gouvernement à mettre en place un cadre juridique approprié et à garantir qu'il soit mis en œuvre de façon efficace, notamment en mettant fin à la pénalisation de la diffamation; relève avec inquiétude les ingérences politiques qui pèsent actuellement sur les médias; demande instamment aux autorités de prendre des mesures immédiates afin de protéger les journalistes des menaces ou d'autres pressions concernant leur travail, notamment celle exercée au moyen d'une utilisation sélective des contrats publicitaires passés par l'État, dans le but de promouvoir des médias indépendants et pluralistes et de donner ainsi aux citoyens du Kosovo un accès à l'information; appelle à une certaine protection des journalistes et à leur donner des garanties minimales en matière de droits et de conditions de travail; plaide pour des mesures visant à assurer la transparence dans la propriété des médias et l'indépendance financière et éditoriale de l'organisme public de radio et télédiffusion, notamment en allouant une part adéquate de sa programmation (20 % par exemple) à des producteurs indépendants, y compris des programmes d'actualité;
