In cooperation with the Member States, the Commission and the High Representative will: · Work towards a coherent EU International cyberspace policy to increase engagement with key international partners and organisations, to mainstream cyber issues into CFSP, and to improve coordination of global cyber issues; · Support the development of norms of behaviour and confidence building measures in cybersecurity. Facilitate dialogues on how to apply existing international law in cyberspace and promote the Budapest Convention to address cybercrime; · Support the promotion and protection of fundamental rights, including access to information and freedom of expression, focusing on: a) developing new public guidelines on freedom of expression online and offline; b) monitoring the export of products or services that might be used for censorship or mass surveillance online; c) developing measures and tools to expand Internet access, openness and resilience to address censorship or mass surveillance by communication technology; d) empowering stakeholders to use communication technology to promote fundamental rights; · Engage with international partners and organisations, the private sector and civil society to support global capacity-building in third countries to improve access to information and to an open Internet, to prevent and counter cyber threats, including accidental events, cybercrime and cyber terrorism, and to develop donor coordination for steering capacity-building efforts; · Utilise different EU aid instruments for cybersecurity capacity building, including assisting the training of law enforcement, judicial and technical personnel to address cyber threats; as well as supporting the creation of relevant national policies, strategies and institutions in third countries; · Increase policy coordination and information sharing through the international Critical Information Infrastructure Protection networks such as the Meridian network, cooperation among NIS ...

Depending on the circumstances, several elements could influence the conditions under which such access is granted, such as: any additional maintenance and adaptation costs; any preventive safeguards to be adopted to limit adverse impacts on network safety, security and integrity; any specific liability arrangements in the event of damages; the use of any public subsidy granted for the construction of the infrastructure, including specific terms and conditions attached to the subsidy or provided under national law in compliance with Union law; the ability to deliver or provide infrastructure capacity to meet public service obligations; any constraints stemming from national provisions aiming at protecting the environment, public health, public security or to meet town and country planning objectives.

Subject to the rules on data protection provided for in Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data , the Commission shall support the exchange of the information referred above among the members of the network, possibly through electronic tools, respecting the confidentiality of business secrets supplied by the relevant undertakings.

(14) The protection of individuals with regard to the processing of personal data is solely governed by Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data(19) and Directive 97/66/EC of the European Parliament and of the Council of 15 December 1997 concerning the processing of personal data and the protection of privacy in the telecommunications sector(20) which are fully applicable to information society services; these Directives already establish a Community legal framework in the field of personal data and therefore it is not necessary to cover this issue in this Directive in order to ensure the smooth functioning of the internal market, in particular the free movement of personal data between Member States; the implementation and application of this Directive should be made in full compliance with the principles relating to the protection of personal data, in particular as regards unsolicited commercial communication and the liability of intermediaries; this Directive cannot prevent the anonymous use of open networks such as the Internet.
(14) La protection des personnes physiques à l'égard du traitement des données à caractère personnel est uniquement régie par la directive 95/46/CE du Parlement européen et du Conseil du 24 octobre 1995 relative à la protection des personnes physiques à l'égard du traitement des données à caractère personnel et à la libre circulation de ces données(19) et par la directive 97/66/CE du Parlement européen et du Conseil du 15 décembre 1997 concernant le traitement des données à caractère personnel et la protection de la vie privée dans le secteur des télécommunications(20), qui sont pleinement applicables aux services de la société de l'information. Ces directives établissent d'ores et déjà un cadre juridique communautaire dans le domaine des données à caractère personnel et, par conséquent, il n'est pas nécessaire de traiter cette question dans la présente directive afin d'assurer le bon fonctionnement du marché intérieur, et notamment la libre circulation des données à caractère personnel entre les États membres. La mise en oeuvre et l'application de la présente directive devraient être conformes aux principes relatifs à la protection des données à caractère personnel, notamment pour ce qui est des communications commerciales non sollicitées et de la responsabilité des intermédiaires. La présente directive ne peut pas empêcher l'utilisation anonyme de réseaux ouverts tels qu'Internet.
