At the moment of signing the Convention this day concluded between Canada and the Portuguese Republic for the avoidance of double taxation and the prevention of fiscal evasion with respect to taxes on income, the undersigned have agreed upon the following provisions which shall be an integral part of the Convention.

May Articles 4(1) and 14(1)(c)(i) of Council Directive 93/38/EEC (1) of 14 June 1993 coordinating the procurement procedures of entities operating in the water, energy, transport and telecommunications sectors, as amended by Directive 98/04/EC (2) of the European Parliament and of the Council of 16 February 1998, and the other provisions of those Directives and the general principles of Community law applicable, be interpreted as meaning that they create obligations for private individuals who are public service concession-holders (in particular an entity covered by Article 2(1)(b) of Directive 93/38/EEC), where that Directive has not been transposed into national law by the Portuguese State, so that failure to fulfil those obligations may be invoked against that private concession-holding entity by the Portuguese State by means of an act attributable to one of its Ministries?

By application lodged at the Court Registry on 24 June 1997, the Commission of the European Communities brought an action for a declaration that, by failing to adopt within the prescribed period the laws, regulations and administrative provisions necessary to comply with Council Directive 79/869/EEC of 9 October 1979 (hereinafter 'the Directive'), and, in the alternative, by not informing the Commission of those measures forthwith, the Portuguese Republic has failed to fulfil its obligations under the third paragraph of Article 189 of the EC Treaty and the combined provisions of Article 13 of the Directive, Article 395 of and Annex XXXVI to the Act concerning the conditions of accession of the Kingdom of Spain and the Portuguese Republic and the adjustments to the Treaties.

The Court: '1. Declares that, by failing to adopt within the prescribed period the laws, regulations and administrative provisions necessary to comply with Council Directive 79/869/EEC of 9 October 1979 concerning the methods of measurement and frequencies of sampling and analysis of surface water intended for the abstraction of drinking water in the Member States, the Portuguese Republic has failed to fulfil its obligations under the combined provisions of that directive and of the Act concerning the conditions of accession of the Kingdom of Spain and the Portuguese Republic and the adjustments to the Treaties;

The new Regulation, scheduled for adoption by the Council as an 'A' point at the next Council Meeting, will make a marked contribution to stronger and more efficient monitoring through the use of new technology. c) Further, the proposal lays down specific control obligations for the fishing vessels affected by these adjustments by introducing a system of compulsory prior authorization of access to fisheries involving issuing of fishing licences at national level. d) In line with the Council's conclusions and the 1992 report, the Commission does not propose to renew certain provisions of the Act of Accession expiring on December 1995: - the prohibition on vessels flying the Spanish or Portuguese flag from fishing in the zone south of latitude 56°30' N, east of longitude 12° W and north of latitude 50°30' N (Irish box) - the restrictions on fishing for albacore and tropical tuna by vessels of the Ten in all or part of Portuguese waters (Azorian box) - the terms of access of Spanish vessels to Portuguese waters and vice versa set by the bilateral agreement between Spain and Portugal. 2. Timetable - Council Presentation by Commission to Council of Ministers on 20.10.93 Adoption by Council of Ministers scheduled for 20.12.93 - Parliament Discussion in subcommittee scheduled for mid-November Adoption of opinion scheduled for plenary session on 13 to 17.12.93. Conclusion Mr Paleokrassas stressed the importance of the proposal as marking the definitive inclusion of Spain and Portugal in the general arrangements governing an economic activity of importance to both countries.

Il s'agit notamment: - de l'interdiction pour les navires battant pavillon espagnol ou portugais d'accéder aux eaux de la zone située au sud du 56°30' de latitude Nord, à l'Est du 12° de longitude Ouest et au Nord de 50°30' de latitude Nord (Irish box), - des limitations concernant la pêche au thon germon et au thon tropical, pour les navires des Dix, dans tout ou partie des eaux portugaises (Azorian box), - des conditions d'accès des navires espagnols dans les eaux portugaises et réciproquement, fixées par l'accord bilatéral entre l'Espagne et le Portugal. 2.
