Notes that, in adopting measures to counter UTPs within the food supply chain, due account must be taken of the specific features of each market and the legal requirements that apply to it, the different situations and approaches in individual Member States, the degree of consolidation or fragmentation of individual markets, and other significant factors, while also capitalising on measures already taken in some Member States that are proving to be effective; takes the view that any proposed regulatory efforts in this area should ensure that there is relatively broad discretion to tailor the measures to be taken to the specific features of each market, in order to avoid adopting a ‘one-size-fits-all’ approach, and should be based on the general principle of improving enforcement by involving the relevant public bodies alongside the concept of private enforcement, thus also contributing to improving the fragmented and low level of cooperation that exists within different national enforcement bodies and to addressing cross-border challenges regarding UTPs.
note que, pour adopter des mesures de lutte contre les pratiques commerciales déloyales dans la chaîne d'approvisionnement alimentaire, il convient de tenir dûment compte des caractéristiques de chaque marché ainsi que des exigences juridiques qui s'y appliquent, des disparités en termes de situation et d'approche des différents États membres, du degré de concentration ou de fragmentation des marchés ainsi que d'autres facteurs essentiels, en évaluant par ailleurs les mesures déjà prises par certains États qui se révèlent efficaces; est d'avis que toute proposition d'initiative réglementaire en la matière doit garantir une marge de manoeuvre relativement élevée quant aux mesures à prendre en fonction de la nature du marché, pour éviter une approche universelle, et devrait se fonder sur le principe général d'efficacité accrue de l'exécution en associant les organes publics compétents, en y associant le principe du contrôle privé, pour contribuer ainsi à améliorer la coopération actuellement fragmentée et peu développée entre les différents organes nationaux d'exécution et à relever les défis transfrontaliers posés par les pratiques commerciales déloyales.

(3) If an election by a registrant that is a university or public college to determine the net tax for reporting periods of the registrant in accordance with this Part becomes effective in the particular fiscal year of the registrant that is the first fiscal year of the registrant in which the registrant carries on the business of making taxable supplies through a retail establishment (other than a restaurant, cafeteria, pub or similar establishment) and those supplies are primarily supplies of tangible personal property, the special quick-method rate for a particular supply made by the registrant in the course of an activity that the registrant engages in acting in the registrant’s capacity as a university or public college and for reporting periods of the registrant ending in the particular fiscal year is, if it is reasonable to expect that the special quick-method rate for such a supply and for reporting periods of the registrant ending in the fiscal year of the registrant immediately following the particular fiscal year will be a particular percentage set out in subparagraph 19(3)(c)(i), that particular percentage.

Where wholesale distributors supply medicinal products to persons in third countries, they shall ensure that such supplies are only made to persons who are authorised or entitled to receive medicinal products for wholesale distribution or supply to the public in accordance with the applicable legal and administrative provisions of the country concerned.
