In order to ensure that decisions imposing administrative sanctions or other administrative measures taken by competent authorities have a deterrent effect on the public at large, they should normally be published unless the competent authority in accordance with this Regulation deems it necessary to opt for a publication on an anonymous basis, to delay the publication or not to publish.

307 (1) No person shall be deemed to publish a defamatory libel by reason only that he publishes in good faith, for the information of the public, a fair report of the proceedings of the Senate or House of Commons or the legislature of a province, or a committee thereof, or of the public proceedings before a court exercising judicial authority, or publishes, in good faith, any fair comment on any such proceedings.

Council Directives 80/390/EEC of 17 March 1980 coordinating the requirements for the drawing up, scrutiny and distribution of the listing particulars to be published for the admission of securities to official stock exchange listing and 89/298/EEC of 17 April 1989 coordinating the requirements for the drawing up, scrutiny and distribution of the prospectus to be published when transferable securities are offered to the public were adopted several years ago introducing a partial and complex mutual recognition mechanism which is unable to achieve the objective of the single passport provided for by this Directive.
La directive 80/390/CEE du Conseil du 17 mars 1980 portant coordination des conditions d'établissement, de contrôle et de diffusion du prospectus à publier pour l'admission de valeurs mobilières à la cote officielle d'une bourse de valeurs et la directive 89/298/CEE du Conseil du 17 avril 1989 portant coordination des conditions d'établissement, de contrôle et de diffusion du prospectus à publier en cas d'offre publique de valeurs mobilières ont été adoptées il y a plusieurs années, introduisant un mécanisme de reconnaissance mutuelle partiel et complexe qui ne permet pas de réaliser l'objectif consistant à instaurer un passeport unique prévu par la présente directive.
