Council Regulation (EC) No 864/2004 finally extended the tobacco aid to 2008 and 2009 without accordingly extending the funding of the Community Tobacco Fund by a reduction of the tobacco aid.
Le règlement (CE) no 864/2004 du Conseil a finalement étendu la durée de l’aide à 2008 et 2009 sans accroître en conséquence le financement du Fonds communautaire du tabac par une réduction de l’aide au tabac.

Pursuant to Article 110j of Council Regulation (EC) No 1782/2003 establishing common rules for direct support schemes under the common agricultural policy and establishing certain support schemes for farmers and amending certain Regulations tobacco aid is granted to the producers of raw tobacco for the harvest years 2006 to 2009.

Article 104(2) of Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) provides for the funding of the Community Tobacco Fund by the transfer of certain amount of tobacco aid for the calendar years 2006 and 2007 in accordance with Article 110m of Regulation (EC) No 1782/2003.
L’article 104, paragraphe 2, du règlement (CE) no 1234/2007 du Conseil du 22 octobre 2007 portant organisation commune des marchés dans le secteur agricole et dispositions spécifiques en ce qui concerne certains produits de ce secteur (règlement «OCM unique») prévoit le financement du Fonds communautaire du tabac par le transfert d’un certain montant de l’aide au tabac pour les années civiles 2006 et 2007 conformément aux dispositions de l’article 110 quaterdecies du règlement (CE) no 1782/2003.

(a) the agricultural products listed in Annex I to the Treaty on the Functioning of the European Union (hereinafter referred to as ‘the Treaty’), excluding the fishery and aquaculture products listed in Annex 1 to Regulation (EU) No [COM(2011)416] of the European Parliament and of the Council and tobacco;
(a) les produits agricoles énumérés à la liste figurant à l'annexe I du traité sur le fonctionnement de l'Union européenne (ci-après dénommé "le traité") à l'exclusion des produits de la pêche et de l'aquaculture énumérés à l'annexe I du règlement (UE) n° [COM(2011)416] du Parlement européen et du Conseil et du tabac;

(a) ‘new psychoactive substance’ means a natural or synthetic substance that, when consumed by a human, has the capacity to produce central nervous system stimulation or depression, resulting in hallucinations, alterations in motor function, thinking, behaviour, perception, awareness or mood, which is intended for human consumption or is likely to be consumed by humans even if not intended for them with the purpose of inducing one or more of the effects mentioned above, which is neither controlled under the 1961 United Nations Single Convention on Narcotic Drugs, as amended by the 1972 Protocol, nor the 1971 United Nations Convention on Psychotropic Substances; it excludes alcohol, caffeine and tobacco, as well as tobacco products within the meaning of Council Directive 2001/37/EC of 5 June 2001 on the approximation of the laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation and sale of tobacco products ;

Under Council Regulation (EC) No 1911/91, the rates applicable varied between 0.1 and 5%, with the exemption of manufactured tobacco to which a rate of 15% applied. From 1996, these rates were reduced by 20% annually with a view to phasing out the tax completely. It is regrettable that the Commission’s proposal envisages rates of 5%, 15% and even 25%, which are much higher than those previously envisaged and which had been considerably reduced in respect of the APIM. Thus, between 31 July 2000 and 31 December 2001, the rate applicable to tobacco was 3.45%.
Il est à regretter que la proposition de la Commission prévoit des taux de 5%, 15% et même 25%, de loin supérieurs à ceux prévus précédemment et qui dans le cadre de l’APIM avaient déjà été considérablement réduits. Ainsi entre le 31 juillet 2000 et le 31 décembre 2001, le taux applicable sur le tabac était de 3,45%.

In fact, the Directive on tobacco advertising and sponsorship adopted by the Parliament and the Council in 1998 was annulled by the Court of Justice (ECJ) in October 2000. This limits the Community “acquis” in this field to the prohibition of tobacco advertising on television, as a result of the “Television without Frontiers” Directive of 1989.
En effet, la directive en matière de publicité et de parrainage en faveur des produits du tabac, adoptée par le Parlement et le Conseil en 1998, a été annulée par la Cour de justice (CJCE) en octobre 2000, ce qui limite l'acquis communautaire en la matière à l'interdiction de toute publicité en faveur du tabac à la télévision, interdiction qui résulte de la directive "Télévision sans frontières" de 1989.
