Brussels, 26 January 2012 - The European Commission has decided today to refer Bulgaria to the European Court of Justice for having failed to implement correctly different parts of the legislation known as the first railway package. This concerns the implementation of the provisions on charges which railway undertakings have to pay for access to the infrastructure.
Bruxelles, le 26 janvier 2012 – La Commission européenne a décidé aujourd'hui de saisir la Cour de justice de l'Union européenne d'un recours contre la Bulgarie, qui n'a pas transposé correctement différents volets du premier paquet ferroviaire, en l'occurrence les dispositions relatives aux redevances que les entreprises ferroviaires doivent acquitter pour accéder à l'infrastructure.

3. Regrets that the Commission has lost five years to act against this failure and has waited until June 2008 before sending letters of formal notice and until October 2009 to send reasoned opinions for incorrect or incomplete implementation of the first railway package; regrets that the European Commission has not sufficiently focussed its monitoring on the financial foundations of the railway system; urges therefore the Commission to initiate without delay the legal proceedings against the 22 Member States which have not implemented the first railway package;
3. regrette que la Commission ait mis cinq ans pour réagir à cet échec et ait attendu jusqu'à juin 2008 pour envoyer des lettres de mise en demeure et jusqu'à octobre 2009 pour envoyer des avis motivés suite à la mise en œuvre inadéquate ou incomplète du premier paquet ferroviaire; déplore que le contrôle exercé par la Commission n'ait pas été suffisamment axé sur les bases financières du système ferroviaire; invite dès lors instamment la Commission à entamer sans tarder une procédure en justice contre les 22 États membres qui n'ont pas mis en œuvre le premier paquet ferroviaire;

Concerning the legal implementation of the 1 railway package , the report underlines that Member States have to ensure the strict neutrality of the company or body responsible for granting non-discriminatory access to the railway network.
S’agissant de la transposition juridique des mesures constituant le premier paquet ferroviaire , le rapport souligne que les États membres doivent garantir la stricte neutralité de la société ou de l’entité garante de l’accès non discriminatoire au réseau ferroviaire.

The second railway package having entered into force in May 2004 will bring about the establishment of an Integrated European Railway Area.
