TRADUCTIONS EN CONTEXTE

While there has been limited progress in the overall reform of the judicial system, a number of recommendations issued by the Commission in the framework of the Structured Dialogue on Justice are being implemented: in the field of war crimes processing, the determination of jurisdiction for cases has advanced significantly in accordance with the National War Crimes Strategy and with the allocation of the adequate financial and human resources from the relevant budgets and major contributions from IPA.
Les progrès accomplis en ce qui concerne la réforme générale du système judiciaire sont certes limités, mais un certain nombre de recommandations formulées par la Commission dans le cadre du dialogue structuré sur la justice sont en cours de mise en œuvre: dans le domaine du traitement des crimes de guerre, la détermination des juridictions responsables des affaires a fortement progressé, conformément à la stratégie nationale contre les crimes de guerre et grâce à l'affectation des ressources financières et humaines adéquates provenant des budgets correspondants ainsi qu'aux contributions importantes fournies au titre de l'IAP.

– having regard to the Communication from the Commission of 30 May 2008 entitled 'Towards a European e-Justice Strategy' (COM(2008)0329), to the Council Conclusions on a strategy on e-Justice, to Parliament's resolution of 18 December 2008 with recommendations to the Commission on e-Justice, as well as to Parliament’s position of 9 October 2008 on the proposal for a Council decision on the establishment of the European Criminal Records Information System (ECRIS) in application of Article 11 of Framework Decision 2008/XX/JHA and the Council Conclusions on a report on the progress made during the French Presidency in the area of e-Justice adopted at the JHA Council of 27-28 November 2008,
– vu la communication de la Commission du 30 mai 2008 intitulée "Vers une stratégie européenne en matière d'e-Justice" (COM(2008)0329), les conclusions du Conseil relatives à une stratégie en matière d'e-Justice, la résolution du Parlement européen du 18 décembre 2008 contenant des recommandations à la Commission sur l'e-Justice, ainsi que la position du Parlement européen du 9 octobre 2008 sur la proposition de décision du Conseil relative à la création du système européen d'information sur les casiers judiciaires (ECRIS), en application de l'article 11 de la décision-cadre 2008/XX/JAI, et les conclusions du Conseil sur le rapport relatif aux progrès accomplis sous la présidence française dans le domaine de la justice en ligne adoptées lors du Conseil JAI des 27 et 28 novembre 2008,

For the purposes of this Protocol, "draft legislative acts" shall mean proposals from the Commission, initiatives from a group of Member States, initiatives from the European Parliament, requests from the Court of Justice, recommendations from the European Central Bank and requests from the European Investment Bank, for the adoption of a legislative act.
Aux fins du présent protocole, on entend par "projet d'acte législatif", les propositions de la Commission, les initiatives d'un groupe d'États membres, les initiatives du Parlement européen, les demandes de la Cour de justice, les recommandations de la Banque centrale européenne et les demandes de la Banque européenne d'investissement, visant à l'adoption d'un acte législatif.

6. Attaches the utmost importance to its own contribution to the fight against terrorism; therefore urges its Committees on Foreign Affairs and on Civil Liberties, Justice and Home Affairs to find an appropriate procedure for preparing recommendations on the matter to be addressed to both the Council and the Commission; calls, in this respect, on the Council to fully inform and consult the Committee on Foreign Affairs and the Committee on Civil Liberties, Justice and Home Affairs on regular updating of the Council's Common Position 2001/931/CFSP of 27 December 2001 on the application of specific measures to combat terrorism (the list of terrorist groups and organisations), taking into account developments from 2001 onwards; welcomes, in this regard, the positive reaction of the Luxembourg Presidency.
6. attache la plus grande importance à sa propre contribution à la lutte contre le terrorisme; demande donc instamment à ses commissions des affaires étrangères et des libertés civiles, de la justice et des affaires intérieures de concevoir une procédure appropriée par le biais de laquelle le Parlement européen d'adresser tant au Conseil qu'à la Commission des recommandations sur ce sujet; invite à cet effet le Conseil à informer et à consulter comme il se doit la commission des affaires étrangères et la commission des libertés civiles, de la justice et des affaires intérieures concernant l'actualisation régulière de la position commune du Conseil 2001/931/PESC, du 27 décembre 2001, relative à l'application de mesures spécifiques en vue de lutter contre le terrorisme (liste des groupes et organisations terroristes), compte tenu de l'évolution intervenue depuis 2001; se félicite à cet égard de la réaction positive de la Présidence luxembourgeoise.

This recommendation, aimed at creating a mechanism for evaluating the quality of justice anticipates, to a certain extent, a similar mechanism envisaged in Article III-260 of the European Constitution. Under this article, the Council may, on a proposal from the Commission, adopt European regulations or decisions laying down the arrangements whereby Member States conduct objective and impartial evaluation of the implementation by the Member States of policies relating to the area of freedom, security and justice, 'in particular in order to facilitate full application of the principle of mutual recognition'.

2. Notes that as from next year the Court of Justice, pursuant to Article 86(4) of the Financial Regulation, will forward to the European Parliament a report summarising the number and type of internal audits carried out, the recommendations made and the action taken on those recommendations;

13. Notes that the Court of Auditors found five cases where the grounds for claiming exemption from tender procedures were questionable, of which four related to the Court of Justice, and one case (also concerning the Court of Justice) where a procurement need appeared to have been split into several contracts; takes note of the replies of the Court of Justice which justify the procedures followed in all five cases; endorses the recommendation of the Court of Auditors (paragraph 7.30) that “all institutions should apply the same thresholds when deciding whether a proposed procurement of services or supplies falls within the scope of Public Procurement Directives 92/50/EEC and 93/96/EEC”;
13. prend note que la Cour des comptes a constaté cinq cas, dont quatre concernent la Cour de justice, dans lesquels les demandes d'exemption aux procédures d'appel à la concurrence étaient discutables, et un cas (concernant également la Cour de justice) où il est apparu qu'un marché a été scindé en plusieurs contrats; prend note des réponses de la Cour de justice au travers desquelles cette dernière justifie les procédures suivies dans les cinq cas en question; souscrit à la recommandation de la Cour des comptes selon laquelle "toutes les institutions devraient respecter les mêmes seuils pour déterminer si la passation des marchés de services ou de fournitures relève des directives 92/50 et 92/36 concernant la passation des marchés publics";
