Although the aid referred to above is by nature state aid within the meaning of Article 92(1) of the EEC Treaty by virtue of the fact that the state grants extraordinary aid introduced by Law 27/1984 for the benefit of certain firms in order to ease the burden of social costs associated with redundancies, the Commission considers that the aid in question is eligible for the derogation set out in Article 92(3)(c) of the EEC Treaty since, firstly, it helps to reorganize a sector in overcapacity and, secondly, because it forms part of a restructuring plan to restore the firm's profitability and is received directly by the employees and is thus restricted to the partial financing of the social part of the said plan, so that it is aid such as to facilitate the development of an economic activity without adversely affecting Community trade to an extent contrary to the common interest.
Quoique les aides susvisées soient revêtues du caractère des aides d'Etat aux termes de l'article 92.1 CEE du fait de l'octroi par l'Etat des aides extraordinaires établies par la loi 27/1984 au bénéfice de certaines entreprises en vue de l'allègement de charges sociales liées à la réduction de l'emploi, la Commission est d'avis que lesdites aides peuvent bénéficier de la dérogation établie à l'article 92,3, C) du traité CEE car en premier lieu elles contribuent à l'assainissement d'un secteur surcapacitaire et en deuxième lieu, d'une part en s'inscrivant dans le cadre d'un plan de restructuration visant à permettre le retour à la viabilité de l'entreprise et d'autre part en étant perçues directement par les travailleurs et bornées donc au financement partiel du volet social dudit plan, elles sont de nature à favoriser le développement d'une activité économique sans pour autant altérer les échanges communautaires dans une mesure contraire à l'intérêt commun.
