Hence, the committee has taken the unanimous decision to come to Parliament and ask the Commission to provide clear answers in this House, because this affair undeniably raises serious doubts with regard to a violation of the Charter of Fundamental Rights. This is not only because of the Commission’s inertia; it is also and, above all, because of the petitioner Mr Klein’s inability to take legal action.
Nous avons donc décidé à l’unanimité de nous adresser au Parlement et de demander à la Commission qu’elle lui donne des réponses claires. Cette affaire soulève indubitablement de sérieuses suspicions de violation de la Charte des droits fondamentaux, non seulement à cause de l’inertie de la Commission, mais aussi et surtout en raison de l’impossibilité dans laquelle se trouve le requérant, M. Article 355(6) of the Treaty on the Functioning of the European Union (TFEU) allows the European Council, on the initiative of the Member State concerned and acting unanimously after consulting the Commission, to adopt a decision amending the status, with regard to the Union, of a Danish, French or Netherlands country or territory referred to in paragraphs 1 and 2 of Article 355.
L’ article 355, paragraphe 6, du traité sur le fonctionnement de l’Union européenne (TFUE) permet au Conseil européen, sur initiative de l’État membre concerné, d’adopter, à l’unanimité et après consultation de la Commission, une décision modifiant le statut à l’égard de l’Union d’un pays ou territoire danois, français ou néerlandais visé aux paragraphes 1 et 2 dudit article.

Article 355 of the Treaty on the Functioning of the European Union (TFEU) allows the European Council, on the initiative of the Member State concerned and acting unanimously after consulting the Commission, to adopt a decision amending the status, with regard to the Union, of a Danish, French or Netherlands country or territory referred to in paragraphs 1 and 2 of Article 355.

A decision to suspend the reciprocal recognition of regulatory determinations with regard to airline fitness and citizenship and to inform the United States of America thereof in accordance with Article 6 bis(2) of the Agreement as amended by the Protocol shall be taken by the Council, on behalf of the Union and of the Member States, acting unanimously in accordance with the relevant Treaty provisions.

8. Decisions by the Management Board shall be taken by a simple majority of the votes cast, except as regards the decisions referred to in paragraph 5 and points (a), (b), (c), (d), (e), (g), (k) and (l) of paragraph 6, where a two-thirds majority of all members shall be required, and as regards the decisions referred to in Article 25(2), where the Management Board shall act by unanimity.

In this regard, I must point out to them that the language regime is authorised by Council agreements. A unanimous decision in Council is required. Until the relevant decisions are taken, the Presidency must insist on compliance with the Rules of Procedure, regardless of its personal views on the matter.
